Plaintiffs included the incumbent representative for Minnesota’s United States 2nd Congressional District seeking re-election and a voter in the district (“Incumbent/Voter.”) The Defendant was the Minnesota Secretary of State (“Secretary.”) The Intervenor was the Republican candidate for the November 3, 2020 election for Minnesota’s 2nd United States Congressional District (“Second Candidate.”)  

A third major political party candidate for Minnesota’s 2nd Congressional District Representative died on September 21, 2020 (“Deceased Candidate”) after absentee voting began for the November election. After the Deceased Candidate’s death, the Secretary advised that the November 3, 2020, election would not be certified and a special election would need to take place in February 2021, pursuant to state law based on the timing of the Deceased Candidate’s death. See Minn. Stat. § 204B.11

Plaintiffs filed suit in the U.S. District Court for the District of Minnesota on September 28, 2020, seeking declaratory relief to confirm that the postponement provisions of the Minnesota state law based on the Deceased Candidate’s death were unlawful and preempted by federal law, and injunctive relief in the form of prohibiting the Secretary from enforcing the postponement provisions of the state law and to allow the November 3, 2020 election to proceed as required by Federal law. Plaintiffs filed a motion for a preliminary injunction seeking to prevent the defendants from postponing the November 3, 2020 election in the 2nd Congressional district on September 29, 2020. The Second Candidate then intervened on September 30, 2020 in an effort to joint the suit as a defendant and delay the expedited hearing on the preliminary injunction. The case was initially assigned to District Judge Wilhelmina Marie Wright and later referred to District Judge Tony N. Leung. 

On October 9, 2020, the District Court granted plaintiffs' motion for a preliminary injunction and the Second Candidate’s intervention. 493 F.Supp.3d 773. Specifically, the District Court enjoined the Secretary from refusing to give legal effect to the ballots cast in the November 3, 2020 election and ordered the Secretary not to impede the right of Minnesota voters to vote in the November election by communicating to voter’s that their ballots would not be counted.

The Secretary announced unofficial results from the November election as follows:  48.18 % for the Incumbent, 45.92 % for the Second Candidate and 5.83% for the Deceased Candidate. The Second Candidate then filed an appeal with the U.S. Court of Appeals for the Eighth Circuit. The case was assigned to Circuit Judges Loken, Colloton, and Benton. On October 23, 2020, the Eighth Circuit denied the Second Candidate's motion for a stay but granted an expedited appeal. 978 F.3d 1043. The Eighth Circuit found that plaintiffs were likely to succeed on their claim that the Minnesota statute at issue cancelling the election and deviating from the uniform election date was preempted by federal law. The court also noted that under Minnesota law, voters had until October 20, 2020, eleven days after the district court's order, to cancel their ballot and request a new ballot or vote in person if they undervoted.

On November 20, 2020, the Eighth Circuit upheld the injunction and agreed with the district court that the Minnesota state statute’s postponement provision was likely preempted by federal law which establishes a uniform date for congressional elections. 980 F.3d 614. Further the Eighth Circuit stated that even assuming federal law would “permit a State to cancel an election and thereby produce a ‘failure to elect’ in certain extraordinary situations” federal law “would allow that course only in truly ‘exigent’ circumstances.’”  In addition, the death of the Deceased Candidate was not likely the sort of exigent circumstances that would permit the State to refrain from holding an election for a congressional represenative on November 3, 2020, as required by federal law. Finally, the unofficial results from the election did not suggest that a representative was not elected.  

The Eighth Circuit also clarified that the district court made no error in determining that the plaintiffs and Second Candidate would have suffered irreparable harm without an injunction as the 2nd District would have been left without representation in the House of Representatives between the end of the incumbent’s term in January 2021 and the seating of a new representative after the special election in February 2021. Further, since the likelihood of success on the Complaint was great, the balance of harms and public interest did not weigh against granting the injunction.

On February 4, 2021, the action was dismissed without prejudice based on a stipulation of the parties.  No costs or disbursements were awarded to any party. This case is closed.

TEXT-ONLY ORDER: On October 9, 2020, Intervenor-Defendant Tyler Kistner moved to stay 51 this Court's Order granting Plaintiffs' motion for a preliminary injunction 49 . Motions to stay an injunction are governed by Rule 62, Fed. R. Civ. P., and Rule 8, Fed. R. App. P. A party seeking a stay pending appeal must demonstrate four factors, the most important being that they are likely to succeed on the merits of their claim. Brakebill v. Jaeger, 905 F.3d 553, 557 (8th Cir. 2018). As discussed in detail in this Court's Order granting Plaintiffs' motion for a preliminary injunction 49, Plaintiffs have demonstrated a likelihood of success on the merits of their claim that Minnesota Statutes Section 204B.13 is preempted by federal law. Because this Court concludes Plaintiffs are likely to succeed on the merits of their claim, this Court concludes that Kistner is not likely to succeed on the merits of his appeal.
