This is a case alleging election mismanagement due to voting machine flaws in Memphis. 

On October 12, 2018, the Shelby Advocates for Valid Elections (“SAVE”), a Tennessee non-profit corporation, filed a complaint in the U.S. District Court for the Western District of Tennessee alleging voting machine flaws. The complaint cited multiple software and hardware security issues resulting in inaccurate ballots, insecure memory cartridge management, and impossible vote audits. Plaintiff brought the complaint against the Tennessee Secretary of State, Tennessee Election Commission, Tennessee Coordinator of Elections, Shelby County Election Commission, and Shelby County Election Administrator, all in their respective official capacities. In the complaint, Plaintiff cited the US Constitution (specifically, the Equal Protection Clause in the 14th Amendment) and the Tennessee Constitution (requiring free and equal elections) and filed suit under 42 U.S.C. §1983 and 28 U.S.C. §2201. Further, Plaintiff cited to the Tennessee Election Code and Tennessee Regulation of Elections, which include guidelines of voting safeguards, voting machine certifications, and duties assigned to the Coordinator of Elections and County Election Commission. Plaintiff sought an injunction enjoining defendant to provide paper ballot evidence to prevent due process/equal protection violations and declaratory relief. Plaintiff was represented by a private attorney based in Memphis.  The case was assigned to Judge Thomas L. Parker and Chief Magistrate Judge Diane K. Vescovo 

In the complaint, plaintiff attempted to certify a class (the population of Shelby County). 

On October 15, 208, plaintiff filed a motion for a temporary restraining order. On October 24, 2018, U.S. District Judge Thomas Lee Robinson Parker denied the motion for a TRO

On May 15, 2019, the defendants filed a motion to dismiss. Then, on September 13, 2019, Judge Parker granted the defendant’s motion to dismiss without prejudice. Plaintiff appealed this decision on October 8, 2019. On January 24, 2020, the Court of Appeals held that individuals lacked imminent injury and thus plaintiff lacked associational and organizational standing. Plaintiff petitioned the U.S. Court of Appeals for the Sixth Circuit for US Supreme Court certiorari, but this failed on October 5, 2020. As a result, the case was closed in October 2020.

Minute Entry for proceedings held before Judge Thomas L. Parker; TRO Hearing held on 10/16/2018. Carol Chumney appeared for the Plaintiffs. Janet Kleinfelter and Matthew Jones appeared for the State of Tennessee Defendants. John Ryder and Pablo Adrian appeared for the Shelby County Defendants. The parties had no objections to Judge Parker hearing this case or desire for a recusal. The parties argued the TRO Motion. Plaintiffs' Attorney stated that Shelby County Election's voting machines (DRE voting machines) are unreliable, not certified and fundamentally unfair voting machines. According to Mrs. Kleinfelter, the Shelby County Election machines are certified by the State of Tennessee and meet both federal and state guidelines. According to John Ryder, the issues of DRE voting machines have been litigated for years and the Courts have ruled in their favor. Mr. Ryder also informed the Court of Shelby County's contingency plans in place to ensure fairness and accountability of the voting machines and the voting process. Motion Hearing set for 6/20/2019 at 10:00 AM in Courtroom 2 - Memphis before Judge Thomas L. Parker. The Court will allow Plaintiffs to substitute named defendants at a later date. The Motion to Stay Discovery 100 is held in abeyance until the 6/20/2019, hearing with no Discovery taking place until then.
