On April 17, 2017, League of Women Voters of Missouri, St. Louis A. Philip Randolph Institute, and Greater Kansas City A. On April 17, 2017, League of Women Voters of Missouri, St. Louis A. Philip Randolph Institute, and Greater Kansas City A. Philip Institute filed a suit against the Missouri Secretary of State and the Director of the Missouri Department of Revenue. The plaintiffs alleged that the defendants continuously failed to comply with portions of the “Motor Vehicle” provisions of the National Voter Registration Act of 1993, 52 U.S.S. § 20501, et seq. (“NVRA”). Plaintiff alleged that the defendants failed to comply with respect to change-of-address and mail transactions for active-duty military personnel and their dependents, and certain in-person license transactions for Missouri citizens over the age of 65, among others. The plaintiffs sought injunctive relief under Section 5 of the NVRA and attorneys’ fees, litigation expenses and costs incurred in connection with the action under 52 U.S.C § 20510(c). Specifically, they sought for the defendants, their officers, agents, employees, and successors in office to develop, implement, and enforce practices and policies to ensure compliance with Section 5 of the NVRA, as well as the court to direct the defendants to take all actions necessary to remedy the past and continuing violations as well as take all actions necessary to ensure future compliance of Section 5 of the NVRA. This case was filed in the United States District Court Western District of Missouri Central Division and assigned to Magistrate Judge Willie J. Epps Jr, and reassigned to District Judge Brian C. Wimes.

Under the NVRA, states must provide voter registration opportunities when individuals apply for or renew their driver’s and nondriver’s licenses and further requires that when a voter updates their address information with the state motor vehicle agency, the state must automatically update the individual’s voter registration record, unless the voter specifically declines to have their voter registration information updated. The plaintiffs alleged that the failure of the defendants to comply with these requirements caused disenfranchisement of voters, given those who move from one county to another without updating their voting registration address before the registration deadline will not have their vote counted. Additionally, the plaintiffs alleged that this also caused undue burden on voters who moved within an election district who did not have their registration updated, since that voter must cast a provisional ballot. The plaintiffs alleged that the failure to comply with these requirements leaves Missouri citizens without the opportunity to vote.

On April 24, 2018 an amended complaint was filed on behalf of the plaintiffs and on November 7th, 2018 a second amended complaint was filed on behalf of the plaintiffs.

On May 15th, 2024, a motion to dismiss for lack of jurisdiction pursuant to 12(b)(1) was filed on behalf of defendant Secretary of State alleging that the plaintiffs lacked standing to assert any claims against the defendant because none of plaintiff’s alleged injuries were fairly traceable to any action of the defendant. On June 21st, 2018, the motion to dismiss was denied by District Judge Brian C. Wimes, who stated that the court found the plaintiffs established Article III standing necessary to confer jurisdiction in the court.

On May 18, 2018, the plaintiffs filed a motion for a preliminary injunction. On September 21, 2018, the plaintiffs motion for preliminary injunction was granted in part and denied in part. On September 26th, 2018 the order for preliminary injunction was amended, and the plaintiffs' motion for preliminary injunction was granted in part and denied in part. The court ordered that the defendants had to immediately address the continuing NVRA violation caused by the current process, send a mailing to all individuals impacted and provide all such individuals the opportunity to update their voter registration information. The other specific relief sought by the plaintiffs was denied until a final decision on the merits.

On November 21, 2019, the plaintiffs filed a “Stipulation and Proposed Order of Dismissal in Light of the Settlement Agreement” which represented that the parties entered into a settlement agreement fully and finally resolving the action except with respect to plaintiff’s application for fees, expenses and costs which was reserved for resolution by the court. On December 20, 2019, the court entered an order of dismissal based on review of the settlement agreement and dismissed the action with prejudice, vacated all pending deadlines and the preliminary injunction order.

On January 6th, 2020, a motion for attorney’s fees was filed on behalf of the plaintiffs. On June 12th, 2020, the plaintiffs' motion for attorney's fees was granted and it was determined that plaintiffs were entitled to reasonable fees in a total amount of $1,143,627.96 and non-taxable expenses in the amount of $27,484.15. On July 13th, 2020, a motion of appeal of the order for attorney’s fees was filed to the United States Court of Appeals for the Eighth Circuit (No: 20-2440). On August 25, 2021 the United States Court of Appeals for the Eighth Circuit ruled that the motion for attorneys fees filed on behalf of the plaintiffs was granted in the amount of $26,937.
