This is a case about the felony disenfranchisement provision of Mississippi’s Constitution, which was enacted in 1890 and strips the right to vote for life from anyone convicted of certain crimes.

On 28 September 2017, Black citizens of Mississippi with past felony convictions brought an action against Mississippi's Secretary of State. The claim was filed in the U.S. District Court for the Southern District of Mississippi. The complaint argued that the disqualifying crimes in the felony disenfranchisement provision of Mississippi’s Constitution were chosen by the 1890 framers with the intent to discriminate against African-Americans and prevent them from voting, and therefore had both a discriminatory intent and impact on Black voters in the state. The plaintiffs sought declaratory and injunctive relief and their costs, expenses and attorneys’ fees.

On March 26 2018, the plaintiffs moved unopposed for leave to file an amended complaint, which was filed on April 5, 2018. On 5 April 2018, the defendant filed a motion to consolidate the case with a similar suit, Hopkins v. Hosemann. On 28 June 2018, the district court granted the motion to consolidate the case with Hopkins. 

On 7 August 2019, the district court severed this case from Hopkins and dismissed the Harness complaint after granting summary judgment in favor of the defendants, holding that the provision, as amended in the 1950s and 1960s, was done “without racial motivation”.

On 28 August 2019, the defendants filed a notice of appeal to the United States Court of Appeals for the Fifth Circuit. On 23 February 2021, the 5th U.S. Circuit Court of Appeals affirmed, but later granted a petition for rehearing en banc.

On 24 August 2022, in an en banc hearing before the full 5th U.S. Circuit Court of Appeals, the Court upheld the felony disenfranchisement provision, finding that the plaintiffs failed to show that the provision was passed with discriminatory intent. Judge Graves authored the lead dissenting opinion that was joined by four other judges.

The plaintiffs filed a petition for a writ of certiorari in the U.S. Supreme Court. On June 30, 2023, the U.S. Supreme Court declined to review the case.
