This is a case about native Hawaiians' right to self determination.
On November 10, 2015, the plaintiff, a resident of Hawaii, filed this suit in the District of Hawaii against the Nai Aupuni Directors and the Office of Hawaiian Affairs Trustees. The plaintiff alleged that he and his family "are of Kamehameha descendants and are heirs and successors to the Crown Land of Hawaii Nei and we are also Kanaka Mauoli (Original True Man) Nationals", and demanded an injunction to stop Nai Aupuni, an independent organization made up of a volunteer board of directors from the Hawaiian community, to hold its own votes on topics related to Hawaiian self-determination. The Plaintiff alleged that the Defendants violated various articles of the Universal Declaration of Human Rights.
On November 24, 2015, Magistrate Judge Barry M. Kurran recommended that that this action be dismissed without leave to amend. This recommendation was adopted by the court on February 26, 2016, finding that "the Declaration does not of its own force impose obligations as a matter of international law." Additionally, the elections at issue were found to be private organizational elections of the Nai Aupuni organization.
