On March 23, 2023, the governor of Idaho signed into law SB 1100, which effectively banned transgender students attending Idaho public schools from using the bathrooms and locker rooms that correspond with their gender identity. Specifically, SB 1100 prohibits Idaho public schools from permitting transgender students from using their preferred restroom and locker room, or else risk facing lawsuits from parents whose children share a bathroom or locker room with a transgender student. The law was set to go into effect on July 1, 2023, before the start of the 2023-24 school year.

In response to the passage of SB 1100, a twelve-year-old transgender girl attending public school in Boise School District, along with her parents and the Sexuality and Gender Alliance (SAGA)—a student organization at Boise High School dedicated to ensuring a safe and welcoming environment for LGBTQ+ students—filed this lawsuit on July 6, 2023. Represented by Lambda Legal Defense & Education Fund and private counsel, they filed their lawsuit in the United States District Court for the District of Idaho against the Idaho State Superintendent of Public Instruction, individual members of the Idaho State Board of Education, the Independent School District of Boise City, and the individual members of the school district’s board. The plaintiffs alleged that SB 1100 violates Title IX and the equal protection and due process clauses of the Fourteenth Amendment by discriminating against transgender students based on their gender identity and forcing the involuntary disclosure of transgender students’ identity in violation of their due process right to privacy. Plaintiffs sought declaratory relief, a preliminary and permanent injunction enjoining defendants from enforcing SB 1100, and nominal damages of $1 along with attorneys’ fees. This case was assigned to District Judge David C. Nye.

Contemporaneously with their complaint, plaintiffs also filed a motion for preliminary injunction, asking the court to enjoin defendants from enforcing SB 1100 while the case proceeded. Plaintiffs specifically argued that their equal protection claim was likely to succeed because it triggered heightened scrutiny  by the court. Under heightened scrutiny analysis, plaintiffs argued that SB 1100 is not substantially related to Idaho’s purported interest in protecting all students’ privacy and safety. Plaintiffs further argued that allowing defendants to enforce SB 1100 as the 2023-24 school year began would irreparably harm transgender students by violating their constitutional rights, subjecting them to profound stigma, increasing their risk of depression, anxiety, and self-harm, interfering with treatment for gender dysphoria, and causing irreversible privacy violations that expose them to danger.

The court set a hearing date of September 13, 2023 for plaintiffs’ motion for preliminary injunction, which was almost a month after the start of the school year. In response, plaintiffs filed a motion for temporary restraining order on July 28, 2023. Relying on the same argumentation as their motion for preliminary injunction, plaintiffs asked that the court temporarily enjoin defendants from enforcing SB 1100 until such time as the court ruled on their motion for preliminary injunction. The court granted plaintiff’s motion for temporary restraining order on August 10, 2023, finding that issuing the temporary restraining order would “preserve the status quo” pending the court’s decision on the preliminary injunction. 2023 WL 5146182.

On August 8, 2023, the United States Department of Justice filed a Statement of Interest, indicating the DOJ’s view that the court should grant plaintiffs’ motion for preliminary injunction.

Defendants filed their opposition to plaintiffs’ motion for preliminary injunction and a motion to dismiss on August 22, 2023. Defendants agreed that plaintiffs’ challenge to SB 1100 warranted heightened scrutiny by the court. However, citing to Adams v. School Board of St. Johns County, in which the en banc Eleventh Circuit upheld a similar bathroom access law in Florida, they argued that plaintiffs’ equal protections and Title IX claims fail because sex-segregated restrooms have long been permissible under Title IX and the Fourteenth Amendment to protect safety and privacy interests. Defendants further argued that any harm SB 1100 might cause to transgender students was remedied by gender-neutral, single-occupancy restrooms.

Following oral argument on September 13, 2023, the district court denied both defendants’ motion to dismiss and plaintiffs’ motion for preliminary injunction on October 12, 2023. 2023 WL 6690596. The district court first acknowledged that there was an existing circuit split on how the equal protection clause and Title IX apply to bathroom laws like SB 1100. Although the Eleventh Circuit in Adams upheld such a law, challenges to similar bathroom laws have succeeded in the Fourth and Seventh Circuits. See Grimm v. Gloucester County School Board, Whitaker by Whitaker v. Kenosha Unified School District, and A.C. by M.C. v. Metro School District of Martinsville.

Adding to the split among courts on this issue, the district court here denied plaintiffs’ motion for preliminary injunction, finding plaintiffs unlikely to succeed on their equal protection, Title IX, or due process privacy claims. Regarding the equal protections claim, applying heightened scrutiny, the court specifically found that SB 1100 classifies students based on sex as opposed to gender identity, and as such, SB 1100 treats students of all sexes equally by mandating that all students use the bathroom corresponding to their biological sex. The court further found that SB 1100 was substantially related to the government’s legitimate state interest in protecting students’ privacy. Regarding plaintiffs’ Title IX claim, the court found Bostock v. Clayton County—in which the United States Supreme Court held that discrimination based on gender identity was necessarily discrimination on the basis of sex under Title VII—to be of limited guidance in this case, since Bostock pertains to Title VII and not Title IX. The court found it dispositive for plaintiffs’ Title IX claim that Title IX explicitly allows sex segregation in the context of bathrooms and locker rooms. Finally, regarding plaintiffs’ due process claim that SB 1100 violated their privacy rights, the court found that plaintiffs’ claim was unlikely to succeed because although gender identity is in fact personal and private, that does not mean that disclosure of identity is a violation of due process privacy rights, and there is little to no case law one way or another. 2023 WL 6690596.

Although the district court denied plaintiffs’ motion for preliminary injunction, the court also denied defendants’ motion to dismiss. The court indicated that defendants’ motion to dismiss was perfunctory and lacked clear explanation, largely resting on the idea that plaintiffs’ claims were based on speculative science. The court declined to examine the science behind the parties’ positions without further discovery, and allowed plaintiffs to continue their claims against defendants, without the preliminary injunction in place. To allow time for Idaho public schools to adjust their policies and communicate with students and parents, the judge ruled that SB 1100 would go into effect on November 2, 2023. 2023 WL 6690596.

Following the district court’s decision, on October 16, 2023, plaintiffs appealed the court’s denial of preliminary injunction to the Ninth Circuit (23-2807). On the same day, plaintiffs also filed an expedited motion for preliminary injunction pending appeal in the district court and the Ninth Circuit, asking both courts to enjoin defendants from enforcing SB 1100 until the Ninth Circuit could rule on the issue. The Ninth Circuit granted the temporary injunction on October 26, 2023. On the same day, the district court declared the plaintiffs’ motion moot due to the Ninth Circuit’s ruling.  2023 WL 7109822.

As of November 20, 2023, this case is pending before the Ninth Circuit, and defendants are enjoined from enforcing SB 1100.
