This case concerns allegations of harassment and abuse experienced by three incarcerated transgender women with gender dysphoria--one pretrial detainee and two post-conviction prisoners. All three alleged failure to protect, failure to provide adequate medical care, and cruel and unusual punishment under the 14th Amendment (for the pretrial detainee) or the 8th Amendment. All three also brought claims under the Equal Protection Clause, the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act of 1973, and state tort law.

The original complaint was filed on April 18, 2023 in the U.S. District Court for the District of Maryland, by one of the post-conviction plaintiffs. (An amended complaint naming all three plaintiffs was filed November 2, 2023.)  All three women were previously or currently incarcerated by the Maryland Department of Public Safety and Correctional Services (DPSCS). This lawsuit's defendants included DPSCS and the Baltimore City Correctional Center (BCCC), as well as numerous named and unnamed officials. The plaintiffs, represented by private counsel, sought declaratory and injunctive relief, compensatory and punitive damages, and attorney’s fees. Judge Richard D. Bennett initially presided over the case, but it was soon reassigned to Judge Matthew J. Maddox. 

The case initially involved just one plaintiff, expanded to two by the first amended complaint, and then to all three by the second amended complaint dated November 2, 2023. Immediately following this amendment, the third plaintiff sought emergency relief: she asked the court to require defendants to (1) remove her from segregation, (2) allow her to particulate in education programs, (3) provide her with consistent hormone treatment and other gender-affirming care, (4) cease retaliating against her for exercising her legal rights and (5) transfer her to an institution for women, in accordance with her gender identity.

On December 4, 2023, the court granted some relief. Specifically, the court ordered that defendants conduct an assessment of the plaintiff’s housing placement to determine whether she should be placed in a facility for women, and required them to ensure that she was provided with prescribed hormone medication and other gender-affirming care. On February 23, 2024, Plaintiff filed a motion to enforce the temporary restraining order and preliminary injunction. This order was granted and denied in part on June 28, 2024, and DPSCS was again ordered to conduct a housing reassessment.

Plaintiffs’ final (fourth amended) complaint included twelve counts. The first six alleged violations of the 8th and 14th Amendment for (1) failure to protect the plaintiffs from violence and housing them with male inmates, (2) failure to provide adequate medical care by refusing to give the women their hormone therapy for their gender dysphoria, and (3) cruel and unusual punishment for their placement in administrative segregation for months because of their transgender status. The women also brought a count alleging sex discrimination, which, they stated, includes discrimination against transgender individuals. The women alleged they were housed with male inmates in spite of their female identity, exposed to heightened risk of sexual assault, and constantly misgendered. Plaintiffs also alleged disability discrimination under both the ADA and Section 504 of the Rehabilitation Act. Plaintiffs alleged the discrimination occurred through the denial of medical treatment and their placement in administrative segregation. The last group of counts, grounded in state tort law, alleged that defendants failed to comply with professional standards of care and DPSCS policies during the women’s detention at their facilities, intentionally inflicted emotional distress and intentionally failed to provide adequate medical care, or to protect them from the risk of sexual abuse. 

On August 15, 2024, Defendants filed a motion to dismiss the final complaint, or in the alternative, a motion for summary judgment. On December 20, 2024 Judge Matthew J. Maddox granted and denied the motion in part. 2024 WL 5186706. By this time, two of the plaintiffs had been released from DPSCS custody, so their injunctive claims were dismissed. As for the other plaintiff, her injunctive claims survived review. Some of the constitutional damages claims were deemed insufficiently specific, but the others remained. Of the disability discrimination claims, Judge Maddox dismissed several based on denial or delay in medical treatment, but allowed the others. The state law claims were also dismissed.

The case is ongoing.
