The plaintiff, a licensed marriage and family therapist practicing in Washington, brought this lawsuit against the Attorney General for the State of Washington, the Secretary of Health for the State of Washington, and the Assistant Secretary of the Health Systems Quality Assurance division of the Washington State Department of Health (together, “defendants”), all in their official capacities, on May 13, 2021 in the U.S. District Court for the Western District of Washington. The plaintiff challenged Washington’s Counseling Censorship Law (CCL), which added “performing conversion therapy on a client under the age eighteen” to the list of conduct that constituted unprofessional conduct for a license holder. Specifically, the plaintiff claimed that the CCL violated (i) his First Amendment right to free speech, (ii) his clients’ First Amendment rights to hear desired information and ideas free from government censorship, (iii) his Fourteenth Amendment right to due process because the law was unconstitutionally vague, (iv) his right to the Free Exercise of religion because it prevented him from speaking in the course of his professional work in a manner consistent with his religious beliefs, and (v) his clients’ right to the Free Exercise of Religion because many of them sought to live consistently with their Christian faith regarding gender identity and sexual attractions and behaviors. Represented in part by Alliance Defending Freedom, the plaintiff sought a declaration that the CCL was void for vagueness, a preliminary and permanent injunction barring enforcement of the CCL, and costs and expenses. The plaintiff filed a motion for a preliminary injunction on the same day he filed his complaint. 

On June 25, 2021, the defendants filed a motion to dismiss. On August 30, 2021, the court issued an order granting the defendant’s motion to dismiss and denying the plaintiff’s motion for a preliminary injunction. The court found that the plaintiff did not have standing to bring his claims on behalf of his patients, but he did have standing to bring claims on his own behalf. However, the court dismissed the remainder of the plaintiff’s claims. The court determined that the CCL did not violate the plaintiff’s right to free speech because it regulated professional conduct, not speech. Neither did the CCL violate the plaintiff’s right to free exercise because the law was facially neutral with respect to religion and there was an exemption for religious practices and counseling. Finally, the court explained that the CCL was not impermissibly vague, especially when applied to licensed mental health providers. Accordingly, the court dismissed the case. 

The plaintiff appealed to the U.S. Court of Appeals for the Ninth Circuit on September 28, 2021. The defendants cross appealed on October 8, 2021, contending that the district court erred in determining that the plaintiff had standing to bring his claims. On September 6, 2022, the Ninth Circuit affirmed the district court’s dismissal. 47 F.4th 1055. The court found that the plaintiff did have individual standing to bring his claims, primarily because he sufficiently alleged a concrete plan to violate the CCL. The court also upheld the district court’s dismissal of the plaintiff’s individual claims. It agreed with the district court that (i) the CCL did not violate plaintiff’s right to free speech because it regulated professional conduct, not speech, (ii) the terms of the CCL were not vague, especially when applied to licensed mental health providers, and (iii) the CCL did not violate plaintiff’s right to free exercise because it was a neutral law of general applicability. The plaintiff subsequently filed a petition for rehearing en banc, which was denied. 

The plaintiff filed a petition for a writ of certiorari to the U.S. Supreme Court on March 27, 2023. The Supreme Court denied that petition on December 11, 2023. 144 S.Ct. 33. The case is now closed.
