Case Summary

On May 19, 2004, an organization of day laborers filed this lawsuit in the United States District Court for the Central District of California under 28 U.S.C. §§ 1331, 1343(a), and 2201, as well as 42 U.S.C. § 1983, against the City of Glendale, California. Plaintiffs claimed that the City was violating the First Amendment rights of day laborers by enforcing an ordinance that made it unlawful to stand on the sidewalk and solicit “employment, business, or contributions of money or other property…

On May 19, 2004, an organization of day laborers filed this lawsuit in the United States District Court for the Central District of California under 28 U.S.C. §§ 1331, 1343(a), and 2201, as well as 42 U.S.C. § 1983, against the City of Glendale, California. Plaintiffs claimed that the City was violating the First Amendment rights of day laborers by enforcing an ordinance that made it unlawful to stand on the sidewalk and solicit “employment, business, or contributions of money or other property from any person traveling in a vehicle along a public right-of way.”

Represented by the Mexican American Legal Defense and Educational Fund (MALDEF) and the Lawyers’ Committee for Civil Rights (Lawyers’ Committee), the plaintiffs sought (1)  a temporary restraining order and permanent injunction against the enforcement of Glendale Municipal Code section 9.17.030; (2) that the same Code section be declared null and void as unconstitutional in violation of the First and Fourteenth Amendments of the United States Constitution; (3) that any and all fines, penalties, or records of infractions of the same Code section be rescinded or removed, and restitution provided; (4) all reasonable attorney fees, costs, and expenses of litigation; and (5) all other relief as the Court would deem just and proper. The case was assigned to Judge Samuel J. Otero and later referred to Judge Charles F. Eick.

On August 10, 2004, the Court denied plaintiff’s ex parte application for a temporary restraining order. Subsequently, on January 14, 2005, the Court issued an order granting plaintiff’s motion for a preliminary injunction against enforcement of Glendale Municipal Code § 9.17.030, finding that the plaintiff was likely to succeed on its claims.

On May 13, 2005, the Court entered a judgment as a matter of law, permanently enjoining the defendant from enforcing the ordinance. The Court held that § 9.17.030 violated the First and Fourteenth Amendments to the Constitution due to vagueness and not being narrowly tailored to serve a significant governmental interest.

The defendant then appealed to the United States Court of Appeal for the Ninth Circuit. However, the parties subsequently engaged in the Ninth Circuit’s mediation program in which the defendant agreed to amend the ordinance so that it was no longer constitutionally suspect.

Following the defendant city’s adoption of an amended ordinance, the parties filed a stipulation with the Court on August 19, 2008, requesting dismissal of the appeal. On August 20, 2008, the Ninth Circuit issued an order dismissing the defendant’s appeal with prejudice.

This case is now closed and no further docket activity has occurred since March 5, 2009.
