This case, brought by two non-profit organizations in Arizona, challenges the voter registration cancellation provisions of Arizona House Bill 2243.

On September 20, 2022, the plaintiffs commenced this action in the United States District Court for the District of Arizona. The plaintiffs filed suit against the Arizona Secretary of State, Arizona Attorney General, Director of the Arizona Department of Transportation, and the County Recorders for each county in Arizona. The plaintiffs alleged that because of unfounded allegations of voter fraud and “illegal aliens” voting in the 2020 Presidential Election, the Arizona legislature enacted Arizona House Bill 2243. The plaintiffs alleged that this new law imposes a series of additional burdens and restrictions that would have the effect of suppressing Latino voters in Arizona and discouraging the applications of new voters and established voters through a series of mandated documentation, proof of citizenship, and identification and verification of information. The Plaintiffs alleged that this constituted an undue burden on the right 
to vote in violation of the First and Fourteenth Amendments; intentional race discrimination in voting in violation of the Fifteenth Amendment; and a violation of Section 8 of the National Voter Registration Act of 1993. The plaintiffs sought declaratory and injunctive relief to halt the House Bill's implementation and enforcement.

On September 26, 2022, the defendant filed the state’s motion to consolidate the case with Mi Familia Vota v. Hobbs which is a case that had been consolidated with four other suits. One of the plaintiffs opposed the motion. On September 27, 2022, another defendant stated that she agreed that the cases should be consolidated and confirmed her joinder to the state’s motion.

On October 26, 2022, the defendants filed a motion for leave regarding motion to dismiss. The defendant argued that the plaintiffs’ argument that Arizona House Bill 2243 discriminates on the basis of “alienage” is not viable because federal law expressly bars noncitizens from voting in elections with candidates for federal office on the ballot. On October 26, 2022, the defendants filed a consolidated motion to dismiss plaintiffs’ complaints under Rules 12(B)(1) and (B)(6) because the defendants argue that some of plaintiffs’ claims are non-justiciable, plaintiffs have not pled viable constitutional claims, and plaintiffs failed to state viable NVRA claims.

On November 10, 2022, the Court granted defendants’ motion to consolidate cases and ordered that there would be no further filings in this case. The result of this case can be found at Mi Familia Vota v. Hobbs
