This is a lawsuit brought by four states—Kansas, Alaska, Utah, and Wyoming—individuals, and nonprofit organizations challenging U.S. Department of Education regulations extending Title IX protections to prohibit discrimination and harassment on the basis of gender identity (the “Final Rule”). The plaintiffs, represented by the state Attorneys General, the Alliance Defending Freedom, the Southeastern Legal Foundation, and the Mountain States Legal Foundation, filed suit against the Department of Education and the Department of Justice in the U.S. District Court for the District of Kansas on May 14, 2024. The plaintiffs sued under the Administrative Procedure Act (APA), alleging that the Final Rule was contrary to Title IX, was in excess of statutory jurisdiction, was arbitrary and capricious, and violated separation of powers principles, the Spending Clause, the First Amendment, the Fifth Amendment, and the Tenth Amendment. The plaintiffs sought a declaratory judgment, preliminary and permanent injunctions, and attorneys' fees. District Judge John W. Broomes was assigned to the case. 

The Final Rule interpreted Title IX’s prohibition on discrimination on the basis of sex to include discrimination on the basis of gender identity and transgender status. In addition, the Final Rule stated that a school may be liable for discrimination under Title IX if it carried out any otherwise permissible distinction or separation based on sex in a manner that results in more than minimal harm. 

The plaintiffs levied a number of statutory and constitutional claims against the Final Rule. They argued that the Final Rule was contrary to Title IX’s text and history, which permitted schools to maintain sex-separate activities and athletics. The plaintiffs distinguished the Supreme Court's decision in Bostock v. Clayton County, which held that Title VII’s prohibition on sex discrimination protects employees from discrimination on the basis of sexual orientation or gender identity. The plaintiffs argued that the holding was limited to the facts and text and history of Title VII.

Among other constitutional concerns, the complaint alleged that the Final Rule was an unconstitutional act of legislative power by an independent agency (in violation of the major questions doctrine), and chilled speech on the viewpoint that sex is immutable. In addition, the plaintiffs also asserted that the rule violated constitutional limits on the Spending Clause because it left States with no real power to decline enforcement, as the Final Rule was tied up with a significant amount of federal funding.

The court granted a preliminary injunction on July 2, 2024, prohibiting the defendants from enforcing the Final Rule against the four plaintiff states and the schools attended by the members of the plaintiff organizations or their minor children. The court determined that the plaintiffs had adequately shown they were harmed, and were likely to prevail on the claims that the Final Rule conflicted with Title IX, was arbitrary and capricious, and violated the major questions doctrine, the Spending Clause, and the First Amendment. 739 F.Supp.3d 902.

On July 10, the defendants appealed the preliminary injunction to the U.S. Court of Appeals for the Tenth Circuit. On July 19, 2024, the plaintiffs’ motion to expand the injunction to cover any school where one of the organizational plaintiffs had a member was denied for lack of jurisdiction, due to the ongoing appeal. The court also denied the defendants' motion for a partial stay pending appeal, which sought to limit the scope of the injunction to cover only a specific part of the Final Rule, and to limit the schools to which the injunction applied. 2024 WL 3471331.

On March 13, 2025, the Tenth Circuit granted the defendants' request to dismiss the appeal. Later that month, on March 21, the court ordered the parties to show cause why the case should not be dismissed as moot, as the new Trump Administration had declared it would enforce the old 2020 Title IX Rule rather than the rule challenged here. The defendants responded a few days later, on March 26, indicating that the case was not technically moot due to ongoing litigation in Tennessee v. Cardona but that it might soon become moot.

The case is ongoing as of April 19, 2025.
