In this case, Tennessee children with disabilities allege that the State of Tennessee subjected children with disabilities to cruel and abhorrent treatment in Tennessee’s self-described “hardware security” juvenile detention facilities.

The primary plaintiffs in this case are three Tennessee children with disabilities (specifically mental illness, intellectual disabilities, and behavior disorders) who have lived in Tennessee's juvenile justice facilities. The other plaintiff is Disability Rights Tennessee (DRT). DRT is a nonprofit organization that provides legal services to people with disabilities; DRT is Tennessee's federally-required protection and advocacy (P&A) network and part of the National Disability Rights Network. DRT is suing defendants in its "associational capacity as the State’s P&A" network.

The plaintiffs filed this class-action lawsuit on June 26, 2024, in the United States District Court for the Middle District of Tennessee. In the complaint, plaintiffs sought class certification. The defendants in this case are the State of Tennessee, the Tennessee Department of Children’s Services (DCS), DCS Commissioner Margie Quin, and Tennessee Commissioner of Education Lizzette Gonzalez Reynolds.

The plaintiffs allege that Tennessee confined children with disabilities in prison-like juvenile correction centers, subjecting those children to “myriad” types of cruelty and abuse. For instance, the plaintiffs allege that Tennessee punished children with disabilities for their symptoms, using measures like solitary confinement, pepper spray, and peer-on-peer violence. The plaintiffs also allege that Tennessee did not provide services designed to treat or rehabilitate children with disabilities, did not provide for those childrens' individualized needs, did not provide those children access to appropriate medical care, subjected those children to violence by juvenile justice facility staff,  and provided those children a “woefully inadequate education.”

Accordingly, per the plaintiffs, Tennessee violated the Americans with Disabilities Act (the ADA), Section 504 of the Rehabilitation Act, and the Eighth and Fourteenth Amendments of the United States Constitution. In their lawsuit, the plaintiffs sought both declaratory and injunctive relief; the plaintiffs requested the court to (1) declare that Tennessee violated the law and (2) order Tennessee to comply with the law. 

The case was assigned to Chief District Judge Waverly D. Crenshaw, Jr.

On October 17, 2024, defendant Commissioner of Education Reynolds filed a motion to dismiss the plaintiffs' sole claim against her - a Fourteenth Amendment procedural due process claim.
