This is a lawsuit challenging the Biden administration's SAVE plan for student loan forgiveness. The Attorneys General of eleven states (Kansas, Alabama, Alaska, Idaho, Iowa, Louisiana, Montana, Nebraska, South Carolina, Texas, and Utah) brought this lawsuit against the Biden administration (President Joseph Biden and Secretary of Education Miguel Cardona, in their official capacities, and the U.S. Department of Education) on March 28, 2024. The complaint was filed in the U.S. District Court for the District of Kansas, and was assigned to District Judge Daniel D. Crabtree and Magistrate Judge Angel D. Mitchell. 

The SAVE plan was created by a rule ("the Final Rule") promulgated by the Department of Education on July 10, 2023. The plan was a modification of the Department's previous income-contingent repayment plan, called REPAYE, which had reduced borrowers' monthly payments based on income and forgiven loans after 20 or 25 years. The changes in SAVE included lower monthly payments (often to $0), no accrued interest, and earlier forgiveness (sometimes as soon as 10 years). 

In this lawsuit, the states argued that the SAVE plan constituted governmental overreach that would substantially harm the states’ economic interests. They sued under the Administrative Procedure Act, raising several challenges to the Final Rule. First, the states argued that the Final Rule violated the constitutional separation of powers by implementing a significant policy change without congressional action, which is barred by the Major Questions Doctrine. The states argued that the doctrine applied because student loan forgiveness was a politically contentious and economically impactful issue, arguing that the price tag of the Final Rule was over $156 billion. The states also alleged that the Final Rule 1) exceeded statutory authority by going beyond what the Higher Education Act of 1965 allowed for “repayment” if the majority of borrowers received loan forgiveness, 2) was arbitrary and capricious, and 3) violated procedural rules due to an insufficient comment period. The states requested injunctive relief permanently enjoining the implementation and enforcement of the SAVE plan, a declaratory judgment holding 1) the Final Rule itself unlawful and 2) that Defendants lacked authority to issue the Final Rule, and attorneys' fees.

On April 5, 2024, the states asked the court to preliminarily enjoin the Department of Education from implementing the Final Rule. Though the Final Rule was not set to take effect until July 2024, the states argued that the Department of Education was already actively implementing it through their forgiveness of student loans, which caused harm to the states. 

The Department of Education moved to dismiss the case for lack of subject-matter jurisdiction and Article III standing on April 26, 2024. They argued that the states lacked standing because the SAVE Plan didn’t cause the states any direct harm. The states filed their response on May 10, 2024. They also filed a first amended complaint on May 16, 2024, clarifying the harm to the states through 1) reduced revenue for the states’ public instrumentalities who own student loans, 2) the loss of future income tax revenue and administrative costs, and 3) harm to their ability to recruit and retain employees to state public service employment. The following day, the court denied the pending motion to dismiss as moot given the contents of the amended complaint. 

In the June 7, 2024 order, the court granted in part and denied in part the Department of Education’s motion to dismiss for lack of jurisdiction. The court dismissed the complaint as it applied to eight of the states (Kansas, Alabama, Idaho, Iowa, Louisiana, Montana, Nebraska, and Utah), finding that they did not have standing to bring the suit. The court cited Biden v. Nebraska, which held that public instrumentalities suffered injury sufficient to establish standing from lost revenue due to student loan forgiveness. Applying that decision in this case here, the court found that only South Carolina, Texas, and Alaska pleaded that the new regulations, more likely than not, would injure their public instrumentalities. The court went on to reject the theory of plaintiffs’ loss of income tax revenue because this loss was self-inflicted and the states could have deviated from the federal definitions of taxable income in order to tax student loan forgiveness. The court also rejected the states’ theory of harm due to reduced state employee recruitment because the Final Rule would theoretically disincentivize would-be public employees from pursuing loan forgiveness through the Public Service Loan Forgiveness (“PSLF”) program. The court concluded that this injury was indirect and hypothetical in nature, meaning that plaintiffs did not plead imminent injury in fact sufficient to establish standing. 2024 WL 2880404.

On June 24, 2024, the court granted the remaining states’ motion for a preliminary injunction. The court enjoined the Final Rule, in part, nationwide. It declined to enjoin the parts of the Final Rule already in effect, noting that it did not want to force the Department of Education to “unforgive” the student loans already forgiven, because states failed to demonstrate that those provisions caused irreparable harm given that the lawsuit was filed after the Final Rule went into effect. However, the court did enjoin the Department of Education from the full implementation of the Final Rule scheduled for July 2024, including a monthly payment cap and payment period limitation. The court also dismissed President Biden as a defendant in the case, finding that the court did not have jurisdiction over the President. 2024 WL 3104578.

Multiple appeals were filed. The Department of Education filed an interlocutory appeal on June 27, 2024 to the U.S. Court of Appeals for the Tenth Circuit, challenging the granting of the preliminary injunction. On the same day, the Department of Education also filed a motion in the district court to stay the injunction pending appeal, or for the court to narrow its injunction to a state-based injunction rather than a nationwide one. The district court denied the stay and the request to narrow the injunction on June 28, 2024. On June 30, 2024, the Tenth Circuit granted the Department’s request in that court for a stay pending appeal and stayed the district court’s preliminary injunction. 

The states dismissed from the action (Kansas, Alabama, Idaho, Iowa, Louisiana, Montana, Nebraska, and Utah, hereinafter “the dismissed states”) also filed an appeal to the Tenth Circuit on July 3, 2024, challenging the dismissal. Finally, the three states remaining as plaintiffs in the action (Alaska, South Carolina, and Texas, hereinafter, the “remaining states”) filed a cross-appeal on July 5, 2024, arguing for expedited briefing without oral argument, based on the precedent from other student-loan forgiveness cases against the Department. 

On July 17, 2024, the dismissed states requested in the district court that final judgment be entered against them to facilitate consideration and resolution of the standing issues in the pending appeal, arguing that the Tenth Circuit would necessarily need to determine standing on appeal. 

On August 23, 2024, the Tenth Circuit abated the appeals in this case in light of the Eighth Circuit’s injunction halting the implementation of the Final Rule nationwide in another case challenging it, Missouri v. Biden. The states in this case asked the Supreme Court to vacate the Tenth Circuit's stay of the district court's injunction, but the Supreme Court denied the request on August 28, 2024 because the Missouri v. Biden injunction was in place.

In a September 9, 2024 status update to the district court, the parties jointly requested that the court stay this litigation for as long as the Eighth Circuit’s injunction of the Final Rule remained in effect. That same day, the court granted a partial stay, staying discovery but declining to stay a ruling on the dismissed states’ July 17th motion for judgment. 

The case was ongoing as of December 2024.

ORDER denying 62 Motion to Modify. Plaintiffs' Motion to Consolidate Hearings. Doc. 62 asks the court to combine two upcoming hearings: one on defendants' Motion to Dismiss for lack of subject matter jurisdiction and one on plaintiffs' Motion for Preliminary Injunction. Plaintiffs assert that many "of the issues that will be addressed at these hearings overlap[.]" Doc. 62 at 1. And, according to plaintiffs, consolidating the hearings will serve the interests of time and judicial economy. Id. While there's a kernel of truth about plaintiffs' reasoning, that kernel isn't big enough to convince the court to combine the two issues--standing and merits--into one hearing. Standing is an essential element of subject matter jurisdiction. And it's imperative that Federal Courts exercise their limited jurisdiction only when it's proper to do so. The Court is resolute about deciding the first question first--have plaintiffs demonstrated that this court has subject matter jurisdiction to decide this case's claims. The Court, in its discretion, concludes that the bifurcated approach established in the court's Memorandum and Order Doc. 44 should remain in effect.
