This is a lawsuit challenging the Biden Administration's SAVE plan for student loan forgiveness. The Attorneys General of seven states (Missouri, Arkansas, Florida, Georgia, North Dakota, Ohio, and Oklahoma) brought this lawsuit against the Biden Administration (President Joseph Biden and Secretary of Education Miguel Cardona, in their official capacities, and the US Department of Education) on April 9, 2024. The complaint was filed in the United States District Court for the Eastern District of Missouri and was assigned to Judge Sarah E. Pitlyk, then reassigned to Judge John A. Ross. 

The SAVE plan was created by a rule ("the Final Rule") promulgated by the Department of Education on July 10, 2023. The SAVE plan was a modification of the Department's previous income-contingent repayment plan, called REPAYE, which had reduced borrowers' monthly payments based on income and forgiven loans after 20 or 25 years. The changes in SAVE included lower monthly payments (often to $0), no accrued interest, and earlier forgiveness (sometimes as soon as 10 years). The states argued that the SAVE plan constituted governmental overreach that would substantially harm the states’ economic interests.

The plaintiffs sued under the Administrative Procedure Act, raising several challenges to the Final Rule. First, the plaintiffs argued that the Final Rule violated the constitutional separation of powers by implementing a significant policy change without congressional action, which is barred by the Major Questions Doctrine. The plaintiffs argued that the doctrine applied because student loan forgiveness was a politically contentious and economically impactful issue. The states further alleged that the Final Rule contradicted the Department's earlier definition of “income-contingent repayment plan” and that the Department had not previously used such a plan to subsidize interest or change the 20-year statutory term for forgiveness. The plaintiffs also alleged that the Final Rule 1) exceeded statutory authority by going beyond what the Higher Education Act of 1965 allowed, 2) was arbitrary and capricious, and 3) violated procedural rules due to an insufficient comment period. The states requested injunctive relief preliminarily and permanently enjoining implementation and enforcement of the SAVE plan, a declaratory judgment, and attorneys' fees.

On April 16, 2024, the plaintiffs asked the court to stay the Final Rule, issue a temporary restraining order, or preliminarily enjoin the rule. The Biden Administration moved to dismiss the case for lack of subject matter jurisdiction and improper venue on May 7, 2024. In its June 24, 2024 order, the court denied the motion to dismiss because it found that Missouri had standing due to its connection with MOHELA, a student loan servicer that is an "instrumentality" of Missouri. It also held that the venue was proper. In the same order, the court granted in part the states’ request for a preliminary injunction. The court held that the plaintiffs were likely to succeed on their claims that the loan forgiveness aspect of the SAVE plan went beyond statutory authority and violated the separation of powers, though it held they were unlikely to succeed on the arbitrary and capricious and procedural violation claims. Though the plaintiffs had asked the court to enjoin the entire Final Rule, it held that the forgiveness portion of the SAVE plan was the only part likely to be unlawful, so it enjoined the federal government from granting any further loan forgiveness for borrowers but left the rest of the Final Rule in place. 2024 WL 3104514.

In response to the June 24 order, the federal government filed an interlocutory appeal to the U.S. Court of Appeals for the Eighth Circuit on June 27, 2024 (docket no. 24-2332). The plaintiffs filed a cross-appeal of the same order on June 28, 2024 (docket no. 24-02351), seeking an expanded injunction to cover not only the loan forgiveness part of the SAVE plan, but to also enjoin the department from implementing other parts of the SAVE plan such as the nonaccrual of interest and the payment-threshold changes. The same day, the plaintiffs moved for an injunction pending appeal in the district court, asking it to fully enjoin the Final Rule. The plaintiffs requested that the district court reconsider its injunction in response to a recent order in Kansas v. Biden, which the plaintiffs relied on to show the entire Final Rule was unlawful. The court denied the motion on July 10, 2024, finding no reason to reconsider its injunction.

At the Eighth Circuit, the plaintiffs moved for an injunction pending appeal and a stay of the entire Final Rule while that motion was pending. On July 18, 2024, the Eighth Circuit stayed the Final Rule; a few weeks later, on August 9, it granted in part the plaintiffs' motion for an injunction pending appeal. The Eighth Circuit explained that, after the district court had issued an injunction against the loan forgiveness aspects of the SAVE plan, the Biden Administration had combined the surviving aspects of the SAVE plan with loan forgiveness aspects of a different repayment plan to essentially circumvent the injunction. In order to prevent this, the Eighth Circuit enjoined the federal government from forgiving SAVE plan loans, failing to charge accrued interest on those loans, or reducing monthly payments based on SAVE's payment-threshold provisions. The Biden Administration subsequently moved for clarification as to the scope of the injunction, but the Eighth Circuit denied the motion on August 19, 2024.

Oral argument in the Eighth Circuit took place on October 24, 2024. This case is ongoing pending a ruling from the Eighth Circuit.
