This case challenged the Tennessee Senate Bill 1971, enacted in 2023, which criminalized helping minors obtain legal abortions out of state unless the minor has written, notarized parental consent to do so. Plaintiffs SisterReach, Inc. and Midwest Access Coalition, Inc. (collectively, “SisterReach”) assist young people in Tennessee in obtaining legal abortion care and other services. On June 26, 2024, SisterReach filed this lawsuit in the United States District Court for the Western District of Tennessee Western Division against the Attorney General of Tennessee and several District Attorney Generals (collectively, “the Attorney General”). SisterReach alleged violations of the Due Process Clause of the Fourteenth Amendment and the First Amendment as the language of the bill was allegedly vague, overbroad, and inhibited freedom of expression and association. Represented by private counsel and The Lawyering Project, the plaintiffs sought declaratory and injunctive relief. This case was assigned to Chief Judge Sheryl H. Lipman.

On June 28, 2024, the court denied SisterReach’s motion for a temporary restraining order; it did not offer any reasoning for its decision. On September 17, 2024, the Attorney General filed for a motion to dismiss for failure to state a claim. As of March 13, 2025, the case is ongoing.
