This lawsuit challenges Florida’s threat to prosecute media organizations that disseminated their advertisements in support of the pro-choice ballot measure in Florida.

On October 16, 2024, Plaintiff, Floridians Protecting Freedom, Inc., represented by private counsel, filed this lawsuit in the United States District Court for the Northern District of Florida, Tallahassee Division, against the State Surgeon General and Head of the Florida Department of Health, and former General Counsel to the Florida Department of Health in his individual capacity. Plaintiff claimed that the Defendants have violated First and Fourteenth Amendment by threatening to prosecute Plaintiff for dissemination of its political advertisements in support of Amendment 4 of Florida’s Constitution to Limit Government Interference with Abortion before the U.S. general election. Plaintiffs brought suit under First and Fourteenth Amendments to the United States Constitution, and under 42 U.S.C. § 1983. It sought declaratory judgment, temporary restraining order against First Defendant, preliminary and permanent injunction against First Defendant, compensation of costs and reasonable attorney’s fees, monetary and punitive damages. The case was assigned to Chief United States District Judge Mark E. Walker.

On October 17, 2024, the court granted temporary restraining order and temporarily enjoined the First Defendant from taking any further actions to coerce, threaten, or intimate repercussions directly or indirectly to television stations, broadcasters, or other parties for airing Plaintiff’s speech, or undertaking enforcement action against Plaintiff for running political advertisements or engaging in other speech protected under the First Amendment. On October 29, 2024, the court extended the temporary restraining order until the issuance of the order on preliminary injunction.

On October 21, 2024, Plaintiff voluntarily dismissed with prejudice all claims against Second Defendant, former General Counsel to the Florida Department of Health.

On 6 November 2024, the court denied Plaintiff’s motion for preliminary injunction. The court argued that since the general election took place and Amendment 4 to Florida’s Constitution did not pass, Plaintiff’s concerns regarding the need to continue advocating in favor of Amendment 4 by broadcasting the ads appear to be moot. In this respect, the court also dissolved the temporary restraining order.

On December 17, 2024, the Plaintiff voluntarily dismissed with prejudice all claims against First Defendant. On the same day, the court ordered the closing of the file.

The case is now closed.
