This case is about the alleged callous indifference exhibited by corrections officers to an incarcerated woman during the course of her high-risk pregnancy, particularly the failure to provide needed medical care and basic accommodations.  On October 13, 2023, a private plaintiff filed this lawsuit in the U.S. District Court of the Northern District of Alabama, Middle Division. She sued Etowah County, the Etowah County Sheriff, the Etowah County Chief of Administration, Doctors’ Care Physicians…

This case is about the alleged callous indifference exhibited by corrections officers to an incarcerated woman during the course of her high-risk pregnancy, particularly the failure to provide needed medical care and basic accommodations. 

On October 13, 2023, a private plaintiff filed this lawsuit in the U.S. District Court of the Northern District of Alabama, Middle Division. She sued Etowah County, the Etowah County Sheriff, the Etowah County Chief of Administration, Doctors’ Care Physicians, P.C. (“Doctors’ Care”), CED Mental Health Services, the Medical Director of Doctors Care, and several medical professionals employed by Doctors Care and/or Etowah County, several named and unnamed corrections officers employed by Etowah County and/or Etowah County Sheriff’s Office. The plaintiff sued under state law. 

The plaintiff, who had been detained at the Etowah County Detention Center (“EDOC”) in 2022, alleged defendants’ had failed to provide her basic accommodations and needed medical care during her pregnancy and after birth. As well, she alleged that defendants had refused to transport her to the hospital when she was in labor, thus forcing her to endure 12 hours of unmedicated labor and give birth in the jail, and delayed in providing her needed medical care  after the birth. Represented by the Southern Poverty Law Center, Pregnancy Justice, and private counsel, plaintiff argued that defendants’ actions violated her rights under the Fourteenth Amendment and Alabama common law.  She sought redress for these violations. and compensation for physical and emotional damages. 

On November 6, 2023, eight of the named defendants filed a motion to dismiss the claims brought against them in their official capacities. 

On November 20, 2023, plaintiffs filed an amended complaint against all the defendants in the case. In light of this, the court terminated as moot defendants’ motion to dismiss on December 20. 

On March 5, 2024, the plaintiff filed a second amended complaint against all defendants. This complaint very briefly expanded on the fact section.  

As of November 5, 2024, the case is ongoing.
