This is a case about the validity of privacy rules established by the Department of Health and Human Services (HHS) which restrict states' investigating authority in connection with reproductive health care.

On September 4, 2024, the State of Texas filed this lawsuit in the U.S. District Court for the Northern District of Texas against HHS, the Secretary of HHS, and the Director of the HHS Office for Civil Rights. Texas challenged a rule enacted by HHS in 2024 ("the 2024 Rule") related to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), which regulates the disclosure of private medical information. The 2024 Rule (published at 89 Fed. Reg. 32,976) barred entities from disclosing protected health information that would be used to investigate someone for, or hold someone liable for, "seeking, obtaining, providing, or facilitating reproductive health care," as long as the entity reasonably believes the reproductive health care was permitted by state or federal law.

Texas also challenged a 2000 rule promulgated by HHS that restricted when state officials or investigators could access protected health information ("the 2000 Rule"). The 2000 Rule (published at 65 Fed. Reg. 82,462) barred an entity from disclosing protected information in response to an administrative subpoena unless the information was "material to a legitimate law enforcement inquiry," the subpoena was "limited in scope," and "[d]e-identified information could not reasonably be used."

Texas sued under the Administrative Procedure Act, arguing that the 2000 Rule and 2024 Rule (i) exceeded HHS's statutory authority under HIPAA and (ii) were arbitrary and capricious. Texas sought a declaratory judgment, vacatur of the challenged rules, and attorneys' fees. This case was assigned to Judge James Wesley Hendrix.

On January 17, 2025, HHS filed a motion to dismiss for lack of jurisdiction or, in the alternative, for summary judgment. On the same day, the cities of Columbus, Ohio and Madison, Wisconsin, as well as the organization Doctors for America, moved to intervene as defendants.

On January 31, 2025, the court stayed all deadlines in the case at the parties' request to allow the new presidential administration to determine its litigation position. As of March 6, 2025, there have been no further developments.
