This case concerns transgender women inmates’ access to gender-affirming care, including hormone therapy and feminine clothing and grooming standards, in Florida Department of Corrections (FDC) facilities. After a previous suit in 2016 by the same Plaintiff, the FDC had been providing such gender-affirming care. However, on September 30, 2024, the FDC announced a change in policy requiring trans inmates to comply with male clothing and grooming standards within 30 days. Hormone therapy would be available only for medical necessity. The complaint in this case, filed October 25, alleged that FDC and Wakulla Correctional Institution denying this care constituted cruel and unusual punishment under the Eighth Amendment. The case was filed in the Northern District of Florida and assigned to Judge Allen C. Winsor (after Senior Judge William Stafford recused himself). The ACLU of Florida and the national ACLU filed the suit on behalf of Plaintiff (a transgender woman incarcerated in the FDC) and a putative class of all persons incarcerated in the FDC who are or will be diagnosed with gender dysphoria and are or would be considered for hormone therapy and/or access to clothing and grooming standards that accord with their gender identity. The complaint sought emergency, preliminary, and permanent injunctive relief to prevent the change in policy, declaratory relief that this action violated the Eighth Amendment, and attorney’s fees.

Judge Winsor denied the emergency motion for a temporary restraining order on October 29, 2024, because Defendants had not yet received an opportunity to be heard and Plaintiff had not shown that harm would occur between filing and when the preliminary injunction could be resolved. Plaintiff filed a motion for reconsideration on October 30. At a hearing on October 31, Defendant agreed to maintain the status quo with respect to Plaintiff for 30 days or until the hearing for the motion for preliminary injunction.

Defendants filed a motion to dismiss on November 12, 2024. They alleged that Plaintiff had not exhausted administrative remedies, that she lacked standing to assert claims about hormone treatment (because she could not prove actual or threatened injury), that issue preclusion barred relitigation of whether grooming standards are a medically necessary treatment, that she failed to state an Eighth Amendment claim, and that the evidence did not support a class action.

On December 27, 2024, Judge Winsor denied the motion for preliminary injunction because Plaintiff failed to show a substantial likelihood of success on the merits. However, on January 31, 2025, Judge Winsor also denied Defendants’ motion to dismiss because, accepting all factual allegations as true, Plaintiff did make enough of a plausible claim to go forward with discovery.

As of February 2025, the case is ongoing.
