This case is one of several challenging President Trump's effort to narrow birthright citizenship--the Fourteenth Amendment right to U.S. citizenship to individuals born on U.S. soil and "subject to the jurisdiction thereof." You can see all these cases here.
On January 24, 2025, a group of pregnant noncitizens filed this class action lawsuit on behalf of themselves and those similarly situated in the Western District of Washington. Plaintiffs filed suit against President Trump, and a large number of executive departments. Plaintiffs alleged that the Defendants' attempt to narrow birthright citizenship violated the Fourteenth Amendment and Administrative Procedure Act, 5 U.S.C. § 706(2)(B). They sought declaratory and injunctive relief to enjoin Defendants from implementing or enforcing the Executive Order and declare that Plaintiffs’ children born on or after the implementation date of the Executive Order and others similarly situated are U.S. citizens.
Almost immediately after being filed, this case was consolidated with State of Washington v. Trump; information on the consolidated case is located here. This case is closed.
