This case challenged the Trump Administration's efforts to dismantle government programs dedicated to diversity, equity, inclusion, and accessibility ("DEIA") efforts. On February 3, 2025, the National Association of Diversity Officers in Higher Education ("NADHOE"), the American Association of University Professors ("AAUP"), Restaurant Opportunities Centers United ("ROC United"), and the Mayor and City Council of Baltimore filed this suit in the U.S. District Court for the District of Maryland, challenging Trump Administration Executive Orders 14151 and 14173, which direct federal agencies to defund DEIA programs. Represented by Asian Americans Advancing Justice and Democracy Forward, the plaintiffs argued that the orders were unconstitutionally vague, violated the Spending Clause, Due Process Clause, and Separation of Powers, and restricted First Amendment-protected speech. The lawsuit sought an injunction to block enforcement, citing harm to universities, advocacy groups, and local governments. 

At issue were two executive orders signed by President Donald J. Trump in the first days of his administration. On January 20, 2025, Trump issued Executive Order 14151, Ending Radical Government DEI Programs and Preferencing, which directed all federal agencies to eliminate offices, positions, and programs related to DEIA. The Order also mandated the termination of all “equity-related” grants or contracts within 60 days but failed to define “equity-related.” The following day, he issued Executive Order 14173, Ending Illegal Discrimination and Restoring Merit-Based Opportunity, which imposed civil investigations, funding restrictions, and potential legal consequences on institutions and organizations promoting DEIA, asserting that such programs engaged in “illegal discrimination or preferences.”

The plaintiffs argued that these executive orders were unconstitutionally vague and granted excessive discretion to federal agencies, allowing them to arbitrarily revoke funding without clear guidelines. NADOHE’s members, including colleges and universities, feared that research grants and diversity programs may be defunded. AAUP members, many of whom taught or conducted research in racial and gender equity, worried about job security and grant terminations. ROC United, which provided workforce training and advocacy for restaurant workers, received a notice from the Department of Labor instructing it to cease all DEIA-related grant activities. Baltimore, which relied on federal funds for various public services, faced uncertainty regarding whether its equity-focused municipal programs would be affected.

On January 27, 2025, the Office of Management and Budget issued a memorandum ordering a freeze on all federal financial assistance programs that could be implicated under the new rules. The following day, the U.S. District Court for the District of Columbia temporarily blocked enforcement of the freeze in another case, but the White House insisted that the executive orders remained in effect. The plaintiffs pointed to this as evidence of the orders’ sweeping and unpredictable impact, arguing that the executive branch is unlawfully assuming control over federal spending decisions reserved for Congress.

In their lawsuit, the plaintiffs sought immediate injunctive relief to prevent federal agencies from enforcing the orders while the case proceeds. They contended that the executive orders exceeded presidential authority, violated constitutional protections, and imposed unlawful conditions on federal funding. Specifically, they argued that the orders breached the Spending Clause by conditioning federal funds on compliance with vague and shifting standards, infringed Due Process by failing to provide clear notice of prohibited conduct, violated Separation of Powers by bypassing Congress’s power over federal appropriations, and suppressed First Amendment-protected speech by penalizing DEIA-related viewpoints.

The case was assigned to District Judge Adam B. Abelson. The plaintiffs sought a preliminary injunction, and after briefing and a hearing on Feb. 19, 2025, the court largely granted the motion, entering an order forbidding the government to act pursuant to the challenged directives to (a) pause or terminate awards, contracts, or other obligations; (b) require certification of compliance, or (c) bring any False Claims Act enforcement action, or other enforcement action. The court based its decision on the plaintiffs' free speech rights. 

The government appealed this decision to the Fourth Circuit on Feb. 27, 2025 (docket no. 25-01189).  

On March 10, 2025, the court issued a clarified preliminary injunction, further specifying that the government could not pause, freeze, block, cancel, or terminate any awards, contracts, or obligations under the termination provision, require compliance certifications related to DEIA, or bring enforcement actions under the executive orders' provisions.

On March 14, 2025, the U.S. Court of Appeals for the Fourth Circuit lifted the preliminary injunction, allowing the Trump administration to enforce Executive Orders 14151 and 14173 while litigation continued. The three-judge panel emphasized that the decision was procedural and not a final ruling on the legality of the executive orders. While Judges Pamela Harris and Albert Diaz acknowledged concerns about potential constitutional violations, they stated that the orders did not inherently prohibit all DEIA initiatives or violate the First Amendment on their face. The dissenting judge, Allison Rushing, criticized her colleagues’ commentary on DEIA, asserting that policy preferences should not influence judicial decisions. Plaintiffs indicated that they will seek further review, and multiple related lawsuits remain pending.

On March 21, 2025, plaintiffs filed a motion in the district court to vacate the preliminary injunction under Rule 59(e), citing new factual developments, including enforcement letters from HUD and agency interpretations of the executive orders. The court held a hearing on April 10, 2025, but denied the motion on May 1, 2025, concluding that the plaintiffs had not met the high burden required to vacate the prior injunction. However, Judge Abelson reiterated his view that the challenged executive order provisions were likely unconstitutional, noting their vagueness and viewpoint discrimination against DEIA-related speech. He criticized the executive orders as having the purpose and effect of “extinguishing” protected discourse on equity and inclusion across civil society.

On May 7, 2025, plaintiff Restaurant Opportunities Center (ROC) United voluntarily dismissed its claims in full, without prejudice. The claims asserted by the other plaintiffs, however, were not dismissed. 

This case is ongoing.
