This case involves alleged disability discrimination in a city’s health insurance subsidy. On April 11, 2020, a disabled, retired firefighter brought suit in the United States District Court for the Middle District of Florida against the City of Sanford, Florida, alleging discrimination on the basis of disability in violation of the Rehabilitation Act, the Americans with Disabilities Act (ADA), the Equal Protection Clause of the United States Constitution, and state law. Plaintiff, represented by private counsel, sought declaratory and injunctive relief, as well as monetary damages and attorneys' fees. District Judge Wendy W. Berger presided.

The plaintiff alleged that she worked for the City’s fire department for twenty years and took disability retirement in November 2018 after being diagnosed with Parkinson's. When she joined the fire department, the City’s health insurance policy allowed employees retiring for disability reasons, or retiring after 25 years of service, to receive free health insurance until the age of 65. The policy changed in 2003, limiting insurance coverage for disability retirees to twenty-four months after retirement. The plaintiff claimed this change would cost her over $150,000 and that it amounted to discrimination based on her disability.

Soon after the complaint was filed, the City submitted a motion to dismiss, which was partially granted in March 2021. ​​2021 WL 6333059. Specifically, the court dismissed the disability discrimination claims under the Rehabilitation Act, the ADA, and state anti-discrimination law with prejudice, and reasoned that the plaintiff did not qualify as an “individual with a disability” under the statutes because she was retired from her employment when the alleged discrimination occurred.

This case was referred to mediation, but this proved unsuccessful and ended in an impasse. On August 3, 2021, the City filed a motion for summary judgment on the remaining claims; the motion was granted on December 7, 2021. 2021 WL 6333058. The court ruled that the new policy did not violate the Florida statute relating to group insurance and participation by retired employees. The court also reasoned that there was no Equal Protection Clause violation because the policy was supported by legitimate government considerations and therefore passed rational basis review. Judgment in favor of the City was entered the next day. 

On December 30, 2021, the plaintiff filed a notice of appeal to the US Court of Appeals for the Eleventh Circuit. Judges Andrew L. Brasher, Charles R. Wilson, and Britt C. Grant presided. On October 11, 2023, Judge Brasher issued the court’s decision, which affirmed the District Court on all counts. 83 F.4th 1333. For the discrimination claims, the Eleventh Circuit determined that, to fall within the anti-discrimination provision of the ADA, a “plaintiff must hold or desire an employment position with the defendant at the time of the defendant’s allegedly wrongful act.” In this case, the plaintiff sued over termination of benefits when she neither held nor desired to hold an employment position, so her claim was barred. 

On June 24, 2024, the Supreme Court granted a writ of certiorari to determine whether, under the ADA, a former employee loses the right to sue over discrimination with respect to post-employment benefits just because they no longer hold the job. Arguments were held on January 13, 2025. This case is still ongoing.
