This case challenged the Trump Administration's attempt to shrink the workforce in several federal agencies. On February 12, 2025, the National Treasury Employees Union; National Federation of Federal Employees, AFL-CIO; International Association of Machinists and Aerospace Workers, AFL-CIO; International Federation of Professional and Technical Engineers, AFL-CIO; and International Union, United Automobile, Aerospace, and Agricultural Implement Workers of America filed this lawsuit in the U.S. District Court for the District of Columbia. The complaint was filed against President Donald Trump and the acting heads of nine federal agencies and departments–the Office of Personnel Management, the U.S. Department of Treasury, the U.S. Department of Health and Human Services, the Consumer Financial Protection Bureau, the U.S. Forest Service, the Department of Veterans Affairs, the Department of Defense, the National Aeronautics and Space Administration, and the National Institutes of Health.

The plaintiffs challenged the defendants' attempt to fire hundreds of thousands of employees (those considered "nonessential" for purposes of a government shutdown and those on probationary status), and the "deferred resignation program" that pressured federal workers to quit their jobs. The plaintiffs alleged that these actions violated the Separation of Powers and the Administrative Procedure Act. Each plaintiff was represented by their general counsel and private counsel and sought declaratory and injunctive relief and court costs. 

The case was assigned to District Judge Christopher Cooper. On February 14, the plaintiffs sought a temporary restraining order, claiming that the TRO was necessary since mass firings were taking place that would cause great harm to the plaintiffs' membership and dues. The plaintiffs requested the court to enjoin President Trump's Executive Order directing the firing of nonessential employees and the mass firings taking place in various agencies. The court denied emergency relief on February 20, explaining that under the Federal Service Labor-Management Relations Statute (“FSLMRS”), the unions were required to pursue their challenges first in an administrative review process run by the Federal Labor Relations Authority (“FLRA”), with judicial review in the courts of appeals. 2025 WL 561080. 

On May 15, 2025, the defendants filed a motion to dismiss. The defendants argued that under the court's analysis of the plaintiffs' motion for a TRO, the court also lacked jurisdiction over the entirety of the case. On May 27, the plaintiffs requested leave to amend their complaint, while the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America voluntarily dismissed all of its claims. Judge Cooper instructed the government to reply to the plaintiffs' motion to amend by June 4. 

The court granted the plaintiffs' motion to amend, and the plaintiffs filed an amended complaint on June 6. The complaint changed the defendants in the case, which now encompass President Trump and the heads of the Office of Personnel Management (OPM), the Office of Management and Budget (OMB), the Internal Revenue Service, the Department of Health and Human Services, the Consumer Financial Protection Bureau, the U.S. Forest Service, the Department of Veteran's Affairs, the Department of Defense, the Federal Housing Finance Agency, the Commodity Futures Trading Commission, the Federal Trade Commission, the Federal Deposit Insurance Corporation, and the Department of the Interior, along with the Director of the Goddard Space Flight Center of the National Aeronautics and Space Administration. 

The complaint also updated and expanded on the plaintiffs' causes of action. In addition to their separation of powers and APA claims against all the defendant agencies, the plaintiffs also claimed that the attempts to force resignations at the IRS were ultra vires under the Inflation Reduction Act and added additional APA claims against OPM and OMB for their implementation of the executive order.

The defendants filed a motion to dismiss the plaintiffs' amended complaint on July 11. 

The case is ongoing.

MINUTE ORDER: Plaintiff's 42 Motion to Amend the First Amended Complaint is GRANTED. "The most important factor the Court must consider when deciding whether to grant a motion for leave to amend is the possibility of prejudice to the opposing party." Gatling v. Jubilee Hous., Inc., No. CV 20-3770 (FYP), 2022 WL 227070, at *2 (D.D.C. Jan. 26, 2022). The Court concludes that Defendants would not be unduly prejudiced by a second amendment of the complaint at this stage. Indeed, "[c]ourts rarely find prejudice in the early stages of litigation where, as here, discovery has not yet commenced." Id. Moreover, the Court's treatment of the issues in this case will likely benefit from consideration of the more recent developments alleged in the second amended complaint. The Court expresses no view on the merits of the claims in the second amended complaint or Defendant's futility argument, however. Accordingly, the Court hereby STRIKES 41 the government's motion to dismiss. The government shall answer or otherwise respond to the second amended complaint by June 27, 2025.
