This case challenged the Trump Administration's attempt to shrink the workforce in several federal agencies. On February 12, 2025, the National Treasury Employees Union; National Federation of Federal Employees, AFL-CIO; International Association of Machinists and Aerospace Workers, AFL-CIO; International Federation of Professional and Technical Engineers, AFL-CIO; and International Union, United Automobile, Aerospace, and Agricultural Implement Workers of America filed this lawsuit in the U.S. District Court for the District of Columbia. The complaint was filed against President Donald Trump and the acting heads of nine federal agencies and departments–the Office of Personnel Management, the U.S. Department of Treasury, the U.S. Department of Health and Human Services, the Consumer Financial Protection Bureau, the U.S. Forest Service, the Department of Veterans Affairs, the Department of Defense, the National Aeronautics and Space Administration, and the National Institutes of Health. The plaintiffs challenged the defendants' attempt to fire hundreds of thousands of employees (those considered "nonessential" for purposes of a government shutdown and those on probationary status), and the "deferred resignation program" that pressured federal workers to quit their jobs. The Plaintiffs alleged that these actions violated the Separation of Powers and the Administrative Procedure Act. Each plaintiff was represented by their own general counsel.

The case was assigned to District Judge Christopher Cooper. On Feb. 14, the plaintiffs sought a temporary restraining order, but the court denied that emergency relief on Feb. 20, explaining that under the Federal Service Labor-Management Relations Statute (“FSLMRS”), the unions were required to pursue their challenges first in an administrative review process run by the Federal Labor Relations Authority (“FLRA”), with judicial review in the courts of appeals. This case is ongoing.
