This lawsuit challenged three executive orders issued by President Donald Trump in January 2025, which significantly altered federal policies on diversity, equity, inclusion, and accessibility (DEIA) programs and transgender rights. On February 19, 2025, the National Urban League (NUL), the National Fair Housing Alliance (NFHA), and the AIDS Foundation of Chicago (AFC) filed this lawsuit in the United States District Court for the District of Columbia. They named as defendants: President Trump, the Office of Management and Budget, the Office of Federal Contract Compliance Programs, the U.S. Department of Labor, the U.S. Department of Health and Human Services, U.S. Department of Commerce, U.S. Department of Housing and Urban Development, U.S. Department of Agriculture, the National Institutes of Health, the Health Resources and Services Administration, the Centers for Disease Control and Prevention, the Administration for Community Living, the U.S. Environmental Protection Agency, the U.S. Department of Justice, and their corresponding agency heads. The plaintiffs sought injunctive and declaratory relief, arguing these executive orders violated the First and Fifth Amendments of the U.S. Constitution and the Administrative Procedure Act (APA). 

The lawsuit challenged three executive orders. First, Executive Order 14151, titled “Ending Radical and Wasteful DEI Programs and Preferencing” (Jan. 20, 2025), which terminated all federal DEIA programs, positions, grants, and contracts. Second, Executive Order 14168 titled “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government” (Jan. 20, 2025), which eliminated federal recognition of transgender identities and barred agencies from funding “gender ideology.” Third, Executive Order 14173 titled “Ending Illegal Discrimination and Restoring Merit-Based Opportunity” (Jan. 21, 2025), which banned federal contractors and grantees from using DEIA programs and imposed penalties for noncompliance.

The plaintiffs argued these executive orders were in violation of the First Amendment for (1) chilling the plaintiffs’ speech, (2) imposing an unconstitutional restriction on speech, (3) content and viewpoint discrimination, and (4) impermissibly conditioning funding on the relinquishment of plaintiffs’ free speech rights. They also argued the orders violated the Fifth Amendment for being impermissibly vague, thereby allowing for discriminatory and arbitrary enforcement, and denying people adequate notice as to what speech and activities were prohibited. They also argued the orders violated Equal Protection under the Fifth Amendment for discrimination on the basis of race, sex, sexual orientation, gender identity, and transgender status. Finally, they argued the orders violated the Administrative Procedure Act for being arbitrary, capricious, and exceeding executive authority. Plaintiffs requested a declaration that the executive orders were unlawful, unconstitutional, and invalid. They also sought a permanent injunction against the enforcement and implementation of the orders, as well as requiring the defendants to rescind all agency-wide directives implementing the orders.

On the same day they filed the complaint, plaintiffs filed a motion for notice of designation of related civil cases pending, arguing that National Council of Nonprofits, et al. v. Office of Management and Budget, (2025) shared similar operative facts and legal theories as this case. On February 21, Judge AliKhan denied plaintiffs’ motion for notice of designation of related civil cases, and ordered the case to be reassigned–leading to the appointment of Judge Kelly over the proceedings. 

A motion to intervene as a defendant in the case was filed on March 5 by DO NO HARM, a nonprofit dedicated to "promoting controversial programs concerning race and gender." They claimed plaintiffs' challenge to the EOs directly threatened their mission. The court denied their request to intervene on March 12.

The plaintiffs filed a motion for a preliminary injunction on February 28, requesting that defendants be prohibited from "enforcing and implementing key provisions of Executive Order Nos. 14151, 14168, and 141734." The defendants' opposition, filed March 12, argued that (1) the plaintiffs' Fifth Amendment claim failed on the merits because the void-for-vagueness doctrine did not apply where "the President direct[ed] his own subordinates with respect to policy and enforcement priorities;" and (2) the First Amendment claim failed because the plaintiffs did not properly establish that the orders “prohibit[ed] a substantial amount of protected speech relative to [their] plainly legitimate sweep,” so as to be facial unconstitutional.

After a hearing on March 19, the court rejected the preliminary injunction on May 2, 2025, writing:

For half the challenged provisions, Plaintiffs fail to establish a prerequisite to success on the merits: standing.  Presidential directives to subordinates that inflict no concrete harm on private parties—or at least not on these parties— do not present a justiciable case or controversy.  And for the remaining provisions, Plaintiffs’ constitutional claims falter for various reasons.  Two throughlines explain most of them.  The government need not subsidize the exercise of constitutional rights to avoid infringing them, and the Constitution does not provide a right to violate federal antidiscrimination law.  And those pressure points are even harder to overcome for Plaintiffs, who bring facial rather than as-applied challenges.   

The court reserved judgment on the merits of any as-applied challenges to specific enforcement actions the government might initiate. On May 20, the parties filed a joint motion proposing a schedule for the case going forward. The first deadline was on June 27, when the plaintiffs filed their first amended complaint. The amended complaint removed a plaintiff, the National Fair Housing Alliance, and any related factual and legal allegations. The amended complaint added additional details regarding more examples of harm and chilling effects resulting from the defendants' actions. These allegations were intended to support the plaintiffs' First Amendment claims. Finally, the amended complaint removed the plaintiffs' claims under the APA, leaving only their First and Fifth Amendment claims. 

The case is ongoing.
