On February 20, 2025, CASA, Inc. and Make the Road New York filed this lawsuit against Secretary of Homeland Security Kristi Noem and the U.S. Department of Homeland Security (DHS) in the U.S. District Court for the District of Maryland​. On February 20, 2025, CASA, Inc. and Make the Road New York filed this lawsuit against Secretary of Homeland Security Kristi Noem and the U.S. Department of Homeland Security (DHS) in the U.S. District Court for the District of Maryland​. The Plaintiffs challenged Secretary Noem’s decisions (1) to vacate the January 17, 2025 extension of Temporary Protective Status (TPS) for Venezuelans through October 2, 2026 and (2) to terminate TPS for the Venezuelans who initially registered in 2023. The plaintiffs, represented by the Washington Lawyers' Committee for Civil Rights and Urban Affairs, alleged that the defendants' actions violated the Administrative Procedure Act (APA) and the Due Process Clause of the Fifth Amendment​. They asked the court to declare unlawful and set aside DHS's vacatur and termination and to declare that the 2023 TPS designation for Venezuela remains in effect until October 2, 2026. The case was assigned to Judge George Levi Russell, III. 

The plaintiffs argued that Secretary Noem’s actions are invalid because the TPS statute outlines strict procedures by which to terminate a DPS designation. They further asserted that the decision to terminate TPS for Venezuelans was motivated by racial animus, citing discriminatory statements made by Secretary Noem and President Trump, including Secretary Noem referring to Venezuelan TPS holders as "dirtbags" as she announced the vacatur on Fox News​. They also asserted that the defendants' actions would cause irreparable harm, including deportations to an unstable country and the loss of jobs, businesses, and homes.

On March 5, 2025, the plaintiffs filed a motion seeking partial summary judgment declaring that DHS's vacatur and termination were unlawful and had no legal effect. They requested that the court schedule an expedited hearing on their request for partial summary judgment for a date prior to April 7, 2025, the date in which the challenged agency actions will otherwise take effect. 

The defendants moved to stay partial summary judgment briefing and opposed the plaintiffs' motion for an expedited hearing. On March 11, 2025, the district court granted the defendants' motion to stay pending the government's response to the complaint and any resolution of the response. The plaintiffs filed a cross-motion to stay. On April 1, 2025, the court denied the cross-motion as moot in light of Judge Chen's order in National TPS Alliance v. Noem postponing Secretary Noem’s decisions to vacate the extension of the 2023 Designation and to terminate the 2023 Designation for Venezuela. 

The defendants next filed a motion to dismiss on April 28, arguing that the court lacked jurisdiction because the TPS statute bars judicial review of a secretary's designation of a foreign state for TPS relief. The defendants also claimed the decision was one committed to the agency's discretion, meaning that it was not reviewable under the APA. Finally, the defendants argued that the secretary's actions did not violate the APA. Therefore, the defendants asked the court to dismiss the case.

At the parties’ joint request, the court lifted the stay on May 5, 2025, allowing briefing on both the motion to dismiss and the motion for partial summary judgment to proceed concurrently. The plaintiffs filed their opposition on May 19, and the government replied on June 2. On June 17, the plaintiffs filed their reply in support of summary judgment, completing briefing on both motions. A joint status report filed on June 20 confirmed that the motions were fully briefed and ripe for decision.

As of December 2025, both the motion to dismiss and the motion for partial summary judgment remain pending before Judge Russell, and no ruling has been issued. This case is ongoing.
