On Wednesday, February 19, 2025, four labor organizations--who represent hundreds of thousands of employees within dozens of federal agencies and departments--filed this lawsuit in the United States District Court for the Northern District of California against the U.S. Office of Personnel Management and its Acting Director. The plaintiffs were represented by the law firm Altshuler Berzon, State Democracy Defenders Fund, and a few were also represented by their in-house counsel. In their complaint, they challenged the defendants' attempt to fire tens of thousands of "probationary" employees for pretextual reasons. The plaintiffs alleged that these actions violated the Separation of Powers and the Administrative Procedure Act (APA). They sought a declaratory judgment, injunctive relief, and costs and reasonable attorneys' fees.

Over that weekend, on February 23, Elon Musk posted a message on X that said: "Consistent with President @realDonaldTrump’s instructions, all federal employees will shortly receive an email requesting to understand what they got done last week. Failure to respond will be taken as a resignation." This was followed by an email from the Office of Personnel Management (OPM); the email did not repeat the threat of presumed resignation, but subsequent posts from Musk did. The press followed the back-and-forth closely, and the plaintiffs in this case amended their complaint to add the issue on February 23, 2025. The amended complaint also added AFGE Local 2110 and a number of civic organizations--the Main Street Alliance, Coalition to Protect America's National Parks, Western Watersheds Project, Vote Vets Action Fund, and Common Defense Civic Engagement--as plaintiffs. The plaintiffs also moved for Temporary Restraining Order (TRO) on February 23.  

The case was assigned to District Judge William Alsup. After a hearing on February 27, 2025, Judge Alsup entered an oral TRO calling a halt to the firings at agencies that affected the civic organizational plaintiffs. The court's focus was on the fact that direction for the firings came from OPM, which, he said, lacked statutory hiring/firing authority. A written opinion followed on February 28, which confirmed the TRO and set a hearing date of March 13, 2025 for consideration of a preliminary injunction. In that opinion, Judge Alsup expressed doubts about whether the court could appropriately exercise jurisdiction over the union plaintiffs' lawsuit, because the Federal Service Labor-Management Relations Statute (FSLMRS) and the Civil Service Reform Act (CSRA) channeled their complaints via an administrative process. He had no such concern about the civic organizational plaintiffs.

On March 11, 2025, the plaintiffs filed their second amended complaint, adding the plaintiffs American Public Health Association; Association of Flight Attendants-CWA, AFL-CIO; American Geophysical Union; Climate Resilient Communities; Point Blue Conservation Science; and the State of Washington. It also named several federal agencies and their Secretaries as defendants for relief purposes only. 

A few days later, at the hearing on March 13, 2025 Judge Alsup granted the preliminary injunction and ordered additional briefing by April 3 (including regarding the State of Washington's claims) and a hearing on April 9. (The plaintiff State of Washington, who was not added to the lawsuit until March 11, filed their motion for a preliminary injunction on March 26, 2025.) Judge Alsup's opinion followed on March 14. As reported, he ordered six federal agencies--Treasury, Veterans Affairs, Agriculture, Defense, Energy, and Interior--to offer to reinstate any probationary employees who were improperly terminated, amounting to thousands of workers. He added that he was open to expanding his decision later to apply to other agencies where the extent of harms had not been as fully documented yet. Judge Alsup also extended his TRO (from February 27, 2025) against further mass firings by OPM, noting that agencies planning to conduct reductions in force can proceed if they act in accordance with the laws that govern such processes. On March 14, the defendants filed a motion with the district court to stay the order pending appeal, which Judge Alsup denied the next day. 

Within hours of District Judge Alsup's March 13 decision, the defendants appealed to the U.S. Court of Appeals for the Ninth Circuit; the appeal was docketed as 25-1677. They also requested that the Ninth Circuit issue an immediate administrative stay of the district court order, stating that "chaos will ensue absent a stay, as employees who were lawfully terminated must be offered (and may well accept) reinstatement, only to potentially lose their jobs again if the district court's order is vacated." The court denied their request for an immediate administrative stay on March 17, stating, "Given that the district court found that the employees were wrongfully terminated and ordered an immediate return to the status quo ante, an administrative stay of the district court’s order would not preserve the status quo. It would do just the opposite -- it would disrupt the status quo and turn it on its head." 

Meanwhile, on March 17, 2025, District Judge Alsup filed a request for information from the defendants. The request stated: "The Court has read news reports that, in at least one agency, probationary employees are being rehired but then placed on administrative leave en masse. This is not allowed by the preliminary injunction, for it would not restore the services the preliminary injunction intends to restore. Defendants shall state the extent to which any rehired probationary employees are being placed on administrative leave by March 18, 2025, at noon." The next day, the defendants responded that the placement of employees on administrative leave was an administrative, intermediate measure taken by a number of the agencies in order to return probationary employees to full duty status, not an effort to avoid the injunction. 

On March 24, 2025, District Judge Alsup issued two orders (related to his earlier opinion on February 28, 2025): (1) that the district court does have subject matter jurisdiction over the claims by the public-sector union plaintiffs, and (2) requesting briefing by April 4 regarding why the relief extended to the organizational plaintiffs should not be extended to the public-sector union plaintiffs. A hearing was scheduled for April 9, 2025. 

That same day, in response to the Ninth Circuit's March 17 decision to deny the defendants' request for an immediate administrative stay of the district court's March 13 grant of the preliminary injunction, the government submitted an emergency application to the U.S. Supreme Court (filed here). The defendants requested that the Supreme Court stay the district court's injunction pending the appeal in the Ninth Circuit, as well as issue an immediate administrative stay of the injunction while the Supreme Court considered the defendants' application. See OPM v. AFGE, No. 24A904 (S. Ct.). A response is expected by 12:00 p.m. eastern on April 3, 2025. 

On March 26, the Ninth Circuit filed an order and opinion denying the defendants' emergency motion to stay the district court's preliminary appeal. Circuit Judge Bade dissented. 

The same day, March 26, the plaintiffs requested that District Judge Alsup either compel compliance with the court's March 13 preliminary injunction or hold the defendants in contempt. The plaintiffs claimed that the defendants were in violation of the injunction in two ways: (1) by failing to communicate to unlawfully terminated employees the information ordered by the court, and (2) by placing employees whom the court ordered to be immediately reinstated only on "administrative leave" rather than returning them to active service. As support, they pointed to the defendants’ own reporting to the court.

On April 8, 2025, in the U.S. Supreme Court, Justice Kagan referred the government's March 24 application to the Court. In addition, she stayed the district court's March 13 preliminary injunction pending the disposition of the appeal in the Ninth Circuit and disposition of a petition for a writ of certiorari. Justice Kagan explained:

The District Court’s injunction was based solely on the allegations of the nine non-profit-organization plaintiffs in this case. But under established law, those allegations are presently insufficient to support the organizations’ standing. See, e.g., Clapper v. Amnesty Int’l USA, 568 U.S. 398 (2013). This order does not address the claims of the other plaintiffs, which did not form the basis of the District Court’s preliminary injunction.

Additional Justices also weighed in--Justice Sotomayor said she would deny the application, and Justice Jackson would have declined to reach the standing question in the context of an application for emergency relief where the issue is pending in the lower courts and the applicants have not demonstrated urgency in the form of interim irreparable harm. Thus, she would have denied the application too.

The next day (April 9), District Judge Alsup held a hearing on the State of Washington's request for a preliminary injunction (which was filed on March 26, 2025, after the initial plaintiffs' request), as well as the plaintiffs' March 26 motion to compel compliance or hold the defendants in contempt. No decision was made at the time. 

On April 18, 2025, the preliminary injunction was granted by District Judge Alsup to the additional plaintiffs--the State of Washington and the public-sector labor union plaintiffs--including (1) that defendants OPM and its head are enjoined from ordering, directing, or telling any other federal agency to terminate the employment of any federal employee or group of federal employees, and (2) that all defendant agencies who used the OPM template termination notice—or variation thereof—shall provide recipients with a written statement, directed to the employee individually, stating that their termination was not “performance” or fitness based but was made as part of a government-wide mass termination.

This case is ongoing.
