This lawsuit challenged three executive orders issued by President Donald Trump in January 2025, which restricted federal funding for organizations that support transgender rights and diversity, equity, inclusion, and accessibility (DEIA) programs. On February 20, 2025, nine nonprofits—San Francisco Aids Foundation, Gay Lesbian Bisexual Transgender Historical Society, Asian and Pacific Islander Wellness Center, Inc., Los Angeles LGBT Center, Prisma Community Care, Lesbian and Gay Community Services Center, Bradbury-Sullivan LGBT Community Center, Baltimore Safe Haven Corp, and Forge, Inc.—filed this lawsuit in the United States District Court for the Northern District of California. The plaintiffs named as defendants President Trump, the U.S. Department of Justice, the U.S. Department of Labor, the Office of Federal Contracts Compliance Programs, the Office of Management and Budget, the U.S. Department of Health and Human Services, the U.S. Department of Housing and Urban Development, the National Archives and Records Administration, and the National Endowment for the Humanities. Represented by Lambda Legal Defense and Education Fund, Inc., the plaintiffs sought declaratory and injunctive relief, alleging that the executive orders violated the First and Fifth Amendments of the U.S. Constitution, as well as exceeded executive authority.

The lawsuit challenged three executive orders. First, Executive Order 14168 titled “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government” (Jan. 20, 2025), which eliminated federal recognition of transgender identities and banned funding for organizations that acknowledge transgender people. Second, Executive Order 14151 titled “Ending Radical and Wasteful Government DEI Programs and Preferencing” (Jan. 20, 2025), which ordered the termination of all federal DEIA-related programs, grants, and contracts. Third, Executive Order 14173 titled “Ending Illegal Discrimination and Restoring Merit-Based Opportunity” (Jan. 21, 2025), which barred federal contractors and grant recipients from implementing DEIA policies, with penalties for noncompliance.

The plaintiffs argued these executive orders were in violation of the First Amendment for (1) chilling the plaintiffs’ speech, (2) imposing an unconstitutional restriction on speech, (3) content and viewpoint discrimination, and (4) impermissibly conditioning funding on the relinquishment of plaintiffs’ free speech rights. They also argued the orders violated the Fifth Amendment for being impermissibly vague, thereby allowing for discriminatory and arbitrary enforcement and denying people adequate notice as to what speech and activities were prohibited. They also argued the orders violated Equal Protection under the Fifth Amendment, for discrimination on the basis of sex and transgender status. Additionally, they argued the orders were enacted in excess of presidential authority because they usurped the legislative spending power. 

The plaintiffs requested a declaration that the executive orders were unlawful, unconstitutional, and invalid. They also sought a preliminary and permanent injunction against the enforcement and implementation of the orders. The case was assigned to Magistrate Judge Sallie Kim, but on February 25, a notice was issued that the case would be reassigned to a U.S. District Court Judge. The next day, February 26, the case was reassigned to Judge Jon S. Tigar.

On March 3, the plaintiffs filed their motion for a preliminary injunction, asking the court to enjoin Defendants from enforcing all three executive orders while the litigation proceeded. Defendants, after receiving an extension on the deadline to file their reply, were required to respond by April 11. 

On April 7, the Executive Director of the Gay Lesbian Bisexual Transgender Historical Society, the CEO of the Los Angeles LGBT Center, and the CEO of the San Francisco Aids Foundation filed declarations in support of the plaintiffs' motion for preliminary injunction, and alleging additional facts about events that had occurred since plaintiffs filed their motion. Specifically, the declarations detailed federal grants previously awarded to plaintiffs that had since been terminated, and the negative impact of the grant terminations on plaintiffs.
