This case challenged the U.S. DOGE Service’s access to sensitive federal information systems. Since President Trump’s inauguration on January 20, 2025, the U.S. DOGE Service and Elon Musk allegedly initiated a broad and unlawful campaign to access highly sensitive information systems across multiple federal agencies, including the Social Security Administration. This occurred in the broader context of the Trump Administration’s unprecedented reliance on DOGE, a temporary organization created without Congressional authorization. 

On February 21, 2025, the American Federation of State, County and Municipal Employees, AFL-CIO; the Alliance for Retired Americans; and the American Federation of Teachers filed this lawsuit in the U.S. District Court for the District of Maryland. They sued the Social Security Administration, the U.S. Digital Service, and the U.S. DOGE Service Temporary Organization. Specifically, the complaint alleges that DOGE has gained access to the Social Security Administration’s systems, which contain highly sensitive data concerning millions of Americans, including financial, employment, medical, and personal address information. Represented by counsel from Democracy Forward Foundation, the plaintiffs sought declaratory and injunctive relief, including halting DOGE's access to SSA systems and data, deleting unlawfully obtained information, and costs and attorneys’ fees. They claimed that the government’s actions violated various federal laws and constitutional principles, intended to protect privacy and ensure proper governance. These include the Administrative Procedure Act, the Tax Reform Act of 1976, the Privacy Act, the Federal Information Security Modernization Act, the E-Government Act, the Social Security Act, and the Appointments Clause of the U.S. Constitution. This case was assigned to District Judge Ellen Lipton Hollander. 

On March 7, 2025, the plaintiffs filed an amended complaint, adding the Chief Information Officer of the Social Security Administration, the DOGE Acting Administrator, and Elon Musk as Senior Advisor to the President and de facto head of DOGE as defendants. On that day, the plaintiffs also filed a motion for a temporary restraining order, preliminary injunction, or an administrative stay. After a hearing on March 14, 2025, the Court granted the plaintiffs’ motion for a temporary restraining order, enjoining and restraining the defendants from accessing, using, or disclosing any personally identifiable information related to SSA systems. Further, on March 21, 2025, Judge Hollander clarified the terms of the TRO, explaining that employees of SSA who are not involved with the DOGE Team are not subject to the Order. 

The case is ongoing.
