This case challenged Executive Order 14159, titled “Protecting the American People Against Invasion,” which directed the U.S. Department of Justice and the U.S. Department of Homeland Security to impose civil and criminal enforcement actions against “sanctuary jurisdictions” by withholding federal funds.

On February 23, 2025, the cities of Chelsea and Somerville, Massachusetts, filed this lawsuit in the U.S. District Court for the District of Massachusetts against President Donald Trump, the United States, and several other executive agencies and their respective leadership. The plaintiffs asserted that EO 14159 imposed vague and inconsistent criteria, depriving local governments of fair notice as to what conduct could trigger a loss of funding. They alleged that the defendants' ongoing "intimidation campaign" exceeded constitutional limits and sought to compel local governments to enforce federal immigration policy. They argued that the executive branch unlawfully intruded on Congress’s spending power and the judiciary’s role, while also violating principles of federalism by coercing states and localities. They emphasized the resulting threat to public safety and essential services.

The plaintiffs claimed violations of the Separation of Powers, the Spending Clause, the Tenth Amendment, the Fifth Amendment, and the Administrative Procedure Act. Represented by Lawyers for Civil Rights, the plaintiffs sought declaratory relief, injunctive relief, and attorney fees. This case was assigned to Judge Nathaniel M. Gordon. 

On March 31, 2025, the plaintiffs filed an amended complaint that added the U.S. Department of Housing and Urban Development (HUD) and its corresponding agency head, Scott Turner, as defendants. The amended filing brought additional causes of action under the Administrative Procedure Act, alleging that the agency directives associated with the executive order were arbitrary, capricious, and not in accordance with the law, and that they constituted final agency action subject to judicial review. While maintaining the original legal framework, the amended complaint expanded the factual allegations to emphasize the potential harm to public health, law enforcement, and critical infrastructure.

On June 3, 2025, the plaintiffs filed a motion for a preliminary injunction that sought to block enforcement of the funding restrictions. 

In opposition, defendants argued that the plaintiffs' claims were premature because the agencies had not yet decided which grants would be affected and no final agency action had occurred. They asserted that the court lacked jurisdiction over the Department of Transportation grant dispute, which they said belonged in the Court of Federal Claims. On the merits, they contended that the executive order was lawful, the agencies had broad discretion, and the plaintiffs lacked standing and had not shown any constitutional violations. They also argued that the plaintiffs failed to prove irreparable harm and that an injunction would improperly interfere with the executive branch’s authority.

The court heard the plaintiff’s motion for a preliminary injunction on July 17, 2025, denying the motion on October 2, 2025. The court found that, (1) the plaintiffs have not shown that they will imminently lose federal funding such that there is no apparent risk of irreparable injury and (2) the grants in question are already competitive such that the funding the plaintiffs claim they will lose was never guaranteed in the first place, posing no imbalance in equity.

This case is ongoing.
