On March 12, 2025, two doctors filed this lawsuit in the US District Court for the District of Massachusetts. They named the U.S. Office of Personnel Management (OPM), the Department of Health and Human Services, the Agency for Healthcare Research and Quality, and their corresponding agency heads as Defendants.

The Plaintiffs published peer-reviewed articles on a government-run patient safety website (PSNet), and they alleged that the government removed their articles on how to better diagnose patients solely because the articles contained the terms "LGBTQ" and "transgender." Their articles were removed pursuant to Executive Order 14168 and subsequent OPM guidance directing all departments to “[t]ake down all outward facing media . . . that inculcate or promote gender ideology.” The Plaintiffs challenged the OPM guidance and the removal of their articles, alleging that such actions violated the First Amendment and the Administrative Procedure Act. Specifically, the Plaintiffs alleged that Defendants' actions (1) viewpoint-based and unreasonable discrimination in violation of the First Amendment; and (2) arbitrary and capricious, in excess of OPM’s statutory authority, and contravene a constitutional right in violation of the Administrative Procedure Act. 

The Plaintiffs, represented by the ACLU of Massachusetts, ACLU National, and Yale Law School's Media Freedom clinic, sought declaratory and injunctive relief to restore their papers to PSNet.

The Plaintiffs filed a motion for preliminary injunction on April 1, 2025. The Plaintiffs alleged that the OPM guidance and removal of Plaintiffs’ articles from PSNet hamper Plaintiffs’ ability to protect patient safety, educate the medical community, and improve Plaintiffs’ professional standing. As such, Plaintiffs requested that the court enjoin Defendants' ongoing restrictions to Plaintiffs' speech. 

The case was assigned to Judge Leo T. Sorokin. On May 23, he granted the Plaintiffs their requested preliminary injunction. He wrote: 

The plaintiffs are likely to succeed in proving that the removal of their articles was a textbook example of viewpoint discrimination by the defendants in violation of the First Amendment.  Because irreparable harm necessarily flows from such a violation, and the balance of harms and the public interest favor the plaintiffs, the motion for a preliminary injunction is ALLOWED in part.  As explained below, the defendants must restore the patient-safety articles they removed from the online resource at issue.    

On June 16, 2025, defendants filed a motion to dismiss for lack of subject matter jurisdiction. 

This case is ongoing.
