On March 12, 2025, two doctors filed this lawsuit in the US District Court for the District of Massachusetts. They named the U.S. Office of Personnel Management (OPM), the Department of Health and Human Services, the Agency for Healthcare Research and Quality, and their corresponding agency heads as Defendants.

Both plaintiffs published peer-reviewed articles on a government-run patient safety website (PSNet), and alleged that the government removed their articles on patient diagnosis solely because the articles contained the terms "LGBTQ" and "transgender." The articles were removed pursuant to Executive Order 14168 and subsequent OPM guidance directing all departments to “[t]ake down all outward-facing media . . . that inculcate or promote gender ideology.” Plaintiffs challenged the OPM guidance and the removal of their articles, alleging that such actions violated the First Amendment and the Administrative Procedure Act. Specifically, Plaintiffs alleged that Defendants' actions were (1) viewpoint-based and unreasonable discrimination in violation of the First Amendment; and (2) arbitrary and capricious, in excess of OPM’s statutory authority, and contravene a constitutional right in violation of the Administrative Procedure Act. 

Represented by the ACLU of Massachusetts, ACLU National, and Yale Law School's Media Freedom and Information Access Clinic, Plaintiffs sought declaratory and injunctive relief to restore their papers to PSNet.

Plaintiffs filed a motion for preliminary injunction on April 1. They alleged that the OPM guidance and removal of their medical articles from PSNet hampered Plaintiffs’ ability to protect patient safety, educate the medical community, and improve Plaintiffs’ professional standing. As such, they requested that the court enjoin Defendants' ongoing restrictions on Plaintiffs' speech. 

The case was assigned to Judge Leo T. Sorokin. On May 23, he granted the Plaintiffs their requested preliminary injunction. He ruled that plaintiffs were “likely to succeed in proving that the removal of their articles was a textbook example of viewpoint discrimination… in violation of the First Amendment.” He furthermore ordered Defendants to restore the articles that they removed from the web. 784 F.Supp.3d 380. Defendants complied and reposted the articles on May 27. 

On June 16, 2025, defendants filed a motion to dismiss for lack of subject matter jurisdiction. The court denied the motion to dismiss on September 3, asserting that Defendants did not evade litigating this case to its conclusion by involuntarily reposting the medical articles, and still bear the burden of proving that “the allegedly wrongful behavior could not reasonably be expected to recur.”

As a result of the government shutdown on October 1, 2025, the government filed an unopposed motion for a stay of all deadlines, which was approved by Judge Sorokin on October 8. Following the end of the shutdown, on November 18, the parties submitted a status report and a proposed joint schedule for the remainder of the proceedings. 

This case is ongoing.
