These four Executive Orders broadly aimed to reverse federal policies and programs related to DEI, gender identity, and climate change, establishing new presidential policy preferences that federal agencies, including AmeriCorps, were directed to enforce through their grant programs by terminating what the administration deemed as "illegal DEI and DEIA policies" and ensuring federal funds were not used to promote "gender ideology."

Following these orders, AmeriCorps issued its "Executive Order Compliance Instructions" on February 13, 2025 (the "AmeriCorps Directive"), requiring grantees to certify that their programs did not "promote DEI activities." The agency also announced it was reviewing existing awards for alignment with the administration’s priorities. This case challenges the February 13 directive.

On March 10, 2025, the San Francisco Unified School District (SFUSD) and the City of Santa Fe, entities that use AmeriCorps grants to provide services to vulnerable populations, filed this lawsuit in the U.S. District Court for the Northern District of California against AmeriCorps (the Corporation for National and Community Service). Plaintiffs alleged violations of the Separation of Powers, the Spending Clause, and the Administrative Procedure Act, claiming that the conditions were unconstitutionally vague, retroactive, and unrelated to the purpose of the grants. They alleged the directive forced them to either significantly alter essential services or risk losing all federal funding. Represented by public and private counsel, plaintiffs sought declaratory and injunctive relief to invalidate AmeriCorps' actions and allow them to continue using their allocated grant funds for their intended and approved purposes to help their local communities. The case was assigned to Judge Edward M. Chen.

On March 11, 2025, plaintiffs moved for a temporary restraining order and a preliminary injunction. They described their AmeriCorps-funded programs, including San Francisco’s Healthy Choices program, which provides mentoring in 38 schools for high-need students with high truancy and low academic engagement, and Santa Fe’s Foster Grandparent, Senior Companion, and RSVP programs, which support at-risk youth and assist homebound seniors with daily tasks such as grocery shopping and healthcare planning. They argued that the directive forced them to either alter essential services or lose funding, and asserted a likelihood of success on the merits, irreparable harm, and that the equities and public interest favored injunctive relief.

On March 31, 2025, the court granted the temporary restraining order. 2025 WL 974298. It barred enforcement of the challenged conditions, prohibited AmeriCorps from suspending or terminating funding for noncompliance, and enjoined the agency from requiring certifications, modifying grants, or initiating investigations based on the directive during the TRO’s pendency.

On April 23, 2025, the court held that it had subject-matter jurisdiction, rejecting the government’s argument that the Tucker Act granted exclusive jurisdiction to the Court of Federal Claims. It found that plaintiffs primarily sought prospective equitable relief, not monetary damages. 2025 WL 1180729. The court also concluded that federal question jurisdiction was proper because the complaint alleged constitutional and Administrative Procedure Act violations, and that Section 702 of the APA waived sovereign immunity.

Then, on June 18, 2025, Judge Chen granted plaintiffs’ motion for a preliminary injunction. 2025 WL 1713360. The court enjoined AmeriCorps from enforcing the challenged grant conditions while the case proceeds, including initiating investigations, publishing noncompliance lists, or taking enforcement actions under the directive. The court found that the directive represented a sharp departure from AmeriCorps’ statutory mission, which expressly includes addressing economic and racial inequities and promoting diversity. It cited AmeriCorps’ FY 2024 Notice of Funding Opportunity, which prioritized partnerships aimed at alleviating poverty and advancing racial equity, and emphasized support for historically underserved groups, including communities of color, immigrants, LGBTQIA+ individuals, and religious minorities. Grant applicants were awarded points for demonstrating a commitment to diversity, equity, inclusion, and accessibility. The court held that AmeriCorps failed to provide a reasoned explanation for abandoning this longstanding policy framework.
