This case challenged a directive from AmeriCorps that demanded grant recipients comply with new presidential policy preferences and cease activities promoting diversity, equity, and inclusion (DEI), gender ideology, or related to climate change, under threat of losing their funding.

On March 10, 2025, the San Francisco Unified School District and the City of Santa Fe filed this lawsuit in the U.S. District Court for the Northern District of California. The plaintiffs, described generally as entities using AmeriCorps grants to fund support services for vulnerable populations, sued AmeriCorps (the Corporation for National and Community Service), a federal agency. Represented by both public and private counsel, the plaintiffs sought declaratory and injunctive relief. They claimed that AmeriCorps's directive violated the Separation of Powers doctrine, the Spending Clause of the U.S. Constitution, and the Administrative Procedure Act (APA). Specifically, they argued that the conditions were ambiguous, imposed retroactively, and unrelated to the purpose of the grants. The case was assigned to Judge Edward M. Chen.

Shortly after filing their complaint, on March 11, 2025, the plaintiffs also filed a motion for a temporary restraining order (TRO) and an order to show cause why a preliminary injunction should not issue. In their memorandum supporting this motion, they reiterated the background of their AmeriCorps-funded programs, highlighting the critical services they provide to vulnerable students, seniors, and children. They detailed how the Santa Fe Unified School District (SFUSD) uses its grant for the Healthy Choices program to mentor disadvantaged students, and how Santa Fe utilizes its grants for programs like the Foster Grandparent Program, Senior Companion Program, and the Retired & Senior Volunteer Program (RSVP) to support at-risk youth and the elderly. The plaintiffs argued that the new AmeriCorps directive placed them in an untenable position, forcing them to either alter essential program aspects or lose crucial funding. They contended that they were likely to succeed on the merits of their claims, would suffer irreparable harm without immediate relief by having to cut or change vital services, and that the balance of hardships and the public interest strongly favored preliminary relief. They requested the court to prohibit the defendants from enforcing the AmeriCorps Directive and the new conditions, and from withholding funding based on these unlawful requirements. This case is ongoing.
