On March 15, 2025, three Plaintiffs filed this lawsuit in the United States District Court for the Northern District of New York, naming President Donald Trump, the U.S. Department of Homeland Security, and its acting Secretary. The case was assigned to Judge Elizabeth C. Coombe. The Plaintiffs included one noncitizen and two citizens, all of whom were outspoken advocates of Palestine. They challenged provisions of two Executive Orders--EO 14161 and EO 14188--which they alleged unconstitutional…

On March 15, 2025, three Plaintiffs filed this lawsuit in the United States District Court for the Northern District of New York, naming President Donald Trump, the U.S. Department of Homeland Security, and its acting Secretary. The case was assigned to Judge Elizabeth C. Coombe. The Plaintiffs included one noncitizen and two citizens, all of whom were outspoken advocates of Palestine. They challenged provisions of two Executive Orders--EO 14161 and EO 14188--which they alleged unconstitutionally chilled protected speech, prohibiting people from speaking, hearing, or engaging in viewpoints critical of the U.S. or Israeli governments, under threat of criminal prosecution or deportation. They alleged that the EOs violated the First and Fifth Amendments. The Plaintiffs are represented by several individual attorneys, as well as attorneys from Davis, Ndanusa, Ikhlas & Saleem LLP, the American-Arab Anti-Discrimination League, and Project TAHA. The Plaintiffs sought declaratory and injunctive relief, as well as attorney fees.

On the same day, the Plaintiffs filed a motion for temporary restraining order. On March 19, 2025, the Court received an ex parte motion for the TRO. On March 20, 2025, the Court denied the motion and requested that the Plaintiffs show cause by 5pm the same day why the motion should not be shown on the public docket. The Plaintiffs did not show cause. On March 27, 2025, the Plaintiffs filed an amended complaint additionally listing the acting heads of Immigration and Customs Enforcement and the Buffalo Immigration and Customs Enforcement Office as Defendants and filed a TRO to enjoin the Defendants from detaining or removing one of the plaintiffs from the court's jurisdiction.

On March 31, 2025, the Plaintiffs filed a notice for voluntary dismissal without prejudice and on April 2, 2025, the Court closed the case.
