Case Summary

This case challenged the Trump Administration's early termination of Haiti's Temporary Protected Status (TPS). On January 20, 2025, President Trump issued an Executive Order titled "Protecting the American People Against Invasion." The order required that TPS designations be "appropriately limited in scope," and then on February 24, 2025, DHS Secretary Kristi Noem issued a "partial vacatur" of Haiti's TPS designation. This case challenged the Trump Administration's early termination of Haiti's Temporary Protected Status (TPS). On January 20, 2025, President Trump issued an Executive Order titled "Protecting the American People Against Invasion." The order required that TPS designations be "appropriately limited in scope," and then on February 24, 2025, DHS Secretary Kristi Noem issued a "partial vacatur" of Haiti's TPS designation. The notice purported to terminate Haiti's TPS designation as of August 3, 2025. 

On March 14, 2025, the Haitian Evangelical Clergy Association (HECA), nine Haitian individuals with TPS status, and a labor union filed this lawsuit in the U.S. District Court for the Eastern District of New York. Plaintiffs, represented by private counsel from Bryan Cave; Kurzban, Kurzban; and Just Futures, sued Donald J. Trump, Kristi Noem, the Department of Homeland Security, and the United States of America under the Administrative Procedure Act, the Due Process Clause, and the Equal Protection Clause. The case was assigned to District Judge Brian M. Cogan. 

Plaintiffs sought a declaration that Defendants' termination of Haiti's TPS designation:

  • Violates the Administrative Procedure Act;
  • Violates the Fifth Amendment's guarantee of due process and equal protection; and
  • Exceeds the Secretary's statutory authority. 

Plaintiffs also requested that the court set aside the "partial vacatur" of Haiti's TPS designation as unlawful and that the court award costs and attorneys' fees. 

On March 24, Plaintiffs filed a motion for partial summary judgment on their claim that the Secretary of Homeland Security's "partial vacatur" of Haiti's TPS designation exceeds statutory authority and must therefore be set aside as unlawful. On April 15, 2025, Defendants filed a motion to dismiss and an opposition to Plaintiffs' motion for summary judgment. On the same day, Plaintiffs filed a motion for postponement of the effective date of the "partial vacatur" of Haiti's TPS status. 

On July 1, the Court granted Plaintiffs' motions for postponement of the partial vacatur and partial summary judgment. Defendants' motion to dismiss was denied in part, and the court ordered Plaintiffs to show cause as to why their remaining claims were not moot. The Court found that Plaintiffs had standing and that their claims were ripe for judicial review, and thus denied the Government's motion to dismiss on those grounds. The Court further held that it had jurisdiction to review the legality of the partial vacatur and concluded that the Secretary of DHS lacked authority to partially vacate a country's TPS designation. Finally, the Court found that the balance of equities and public interest favored granting Plaintiffs' request to postpone the partial vacatur pending resolution of this case. 

On July 15, pursuant to the Court's order to show cause, Plaintiffs voluntarily dismissed their remaining claims as moot. The Court subsequently entered final judgment in favor of Plaintiffs, granting summary judgment under the APA. 

On July 23, Plaintiffs filed a motion to alter or amend the judgment to explicitly declare that: (1) the Federal Register notice purporting to terminate Haiti's TPS designation is null and void; (2) Haiti's TPS designation remains in effect until February 3, 2026; and (3) employment authorization documents held by Haitian TPS beneficiaries remain valid through that date. On July 28, the Court denied the motion, concluding that the requested relief was unnecessary in light of the Government's public assurance that Haiti remains designated for TPS through February 3, 2026.
