Represented by public interest legal counsel, AFT sought an injunction compelling the Department to reinstate IDR plans and fulfill its statutory obligations. The lawsuit claimed that the Department’s actions violate the Higher Education Act, the Administrative Procedure Act (APA), and contractual rights of borrowers.The case was assigned to Judge Reggie B. Walton.

The lawsuit sought declaratory relief and injunctive relief. AFT argued that the Department’s abrupt decision to halt IDR plans unlawfully prevented borrowers from accessing repayment options tied to their income, causing financial hardship and jeopardizing their eligibility for Public Service Loan Forgiveness (PSLF). 

In February 2025, the Department issued a Stop Work Order, directing servicers to halt IDR applications for at least three months, and did not specify if or when they will be reinstated. AFT’s complaint alleges that this move was driven by political motives rather than legal necessity. It argues that the Department’s failure to process repayment applications violates borrowers’ statutory and contractual rights and constitutes an unlawful withholding of agency action under the APA.

AFT filed a motion for a temporary restraining order on March 24, 2025. The case remains ongoing.
