This case challenged the Trump administration's announced and implemented policy of “ideological deportation,” comprised of large-scale arrests, detentions, and deportations of noncitizen students and faculty who participated in pro-Palestinian protests and other related expression and association. On March 25, 2025, the American Association of University Professors (“AAUP”), three AAUP campus chapters, and the Middle East Studies Association filed this lawsuit in the U.S. District Court for the District of Massachusetts against the U.S. Department of State, the U.S. Department of Homeland Security, U.S. Immigration and Customs Enforcement, and President Donald J. Trump. Represented by private counsel and the Knight First Amendment Institute at Columbia University, the plaintiffs argued that the ideological-deportation policy and related threats violated the First and Fifth Amendments and the Administrative Procedure Act (“APA”). The plaintiffs sought declaratory and injunctive relief as well as attorneys’ fees and costs. The case was assigned to District Judge William G. Young.

The plaintiffs filed a joint motion for a preliminary injunction ("PI") and motion for an expedited briefing schedule on April 1, arguing that the defendants' continued use of the ideological-deportation policy necessitated expedited resolution of the PI motion. The court agreed to expedite the briefing schedule and ordered both parties to submit responsive filings by April 21. A hearing on the preliminary injunction motion will be held on April 23, 2025.

This case is ongoing.
