On March 27, 2025, the U.S. Department of Defense; U.S. Department of Agriculture; U.S. Environmental Protection Agency; U.S. Department of Homeland Security; U.S. Department of Housing and Urban Development; U.S. Department of Justice; U.S. Social Security Administration; and the U.S. Department of Veterans Affairs filed a lawsuit in the U.S. District Court for the Western District of Texas, Waco Division. They sued the American Federation of Government Employees, AFL-CIO, District 10; American Federation of Government Employees National Joint Council of Food Inspection Locals; American Federation of Government Employees Council 238; American Federation of Government Employees Council 222; American Federation of Government Employees Council of Prison Locals C-33; American Federation of Government Employees VA Council; and numerous American Federation of Government Employees Locals.

Represented by counsel to the Assistant Attorney General and the U.S. Department of Justice, the plaintiff agencies sought a declaratory judgment on the basis that a recent Executive Order titled Exclusions from Federal Labor-Management Relations Programs issued by President Trump under his authority from 5 U.S.C. § 7103(b) and similar provisions in the Foreign Service Statute, exempted them from federal labor-management relations programs due to the national security responsibilities of their agencies and subdivisions. The agencies argue that these exemptions void their existing collective bargaining agreements (CBAs) with the Defendant unions. This case has been assigned to Judge Alan D. Albright. 

In their complaint, the agencies detail the backdrop of President Trump's priorities to improve federal workforce efficiency and national security, asserting that existing CBAs, particularly those negotiated near the end of the prior administration, hinder these efforts. They argue that these CBAs restrict return-to-work policies, delegate decision-making to arbitrators, limit the ability to address underperformance (impeding the President's Take Care Clause responsibility under Article II of the Constitution), and impede national security efforts. The Plaintiffs highlight that Congress provided mechanisms for excluding certain agencies from collective bargaining requirements based on national security considerations, including presidential executive orders. They cite President Trump's recent Executive Order, which determined that the Plaintiff agencies (and/or their components) have primary functions related to intelligence, counterintelligence, investigative, or national security work and that collective bargaining cannot be applied consistently with national security requirements. Following this, the Office of Personnel Management (OPM) issued guidance encouraging these agencies to terminate their CBAs and adopt new personnel policies aligned with the President’s priorities. Consequently, the agencies filed this lawsuit to seek legal confirmation of their power to rescind or repudiate these CBAs to protect national security and implement new personnel policies.

The complaint outlines numerous specific examples of restrictive and allegedly onerous terms within the existing CBAs between the Plaintiff agencies and the Defendant unions. These examples include provisions related to telework, performance improvement plans, union representation and activities during work hours, limitations on disciplinary actions, advance notice requirements for reductions in force, and the requirement to bargain over policy changes. The agencies argue that these provisions impede their ability to efficiently manage their workforces, particularly in areas critical to national security. The complaint details the national security and investigative functions of each Plaintiff agency and its components, asserting that these functions justify the President's determination in the Executive Order.

The Defendants filed a motion to dismiss the lawsuit on April 21, 2025. They explained that Article III precludes any federal court from adjudicating the plaintiffs' declaratory judgment action, venue is improper in this district, and the court should exercise its discretion under the Declaratory Judgment Act to decline to entertain a lawsuit that involves the wrong set of parties and was timed to preempt an anticipated
lawsuit against the government. The Plaintiffs filed their opposition to the motion on May 5, and Judge Albright held a hearing on the motion on June 10. 

Judge Albright granted the defendants' motion to dismiss on July 23, stating that the "[p]laintiffs ask this Court to do something it should not and cannot do: issue a declaratory judgment pre-approving the acts of executive agencies absent a legally cognizable injury-in-fact. This Court is unable to identify a single instance in which a federal court has exercised jurisdiction over agencies seeking a pre-enforcement declaratory judgment approving their desired future course of conduct." The court found that it lacked jurisdiction for two reasons: "First, Plaintiffs’ articulated injuries are not redressable injuries-in-fact sufficient to confer standing. Second, Plaintiffs seek an impermissible advisory opinion by requesting this Court’s preemptive approval of Plaintiffs’ desired future conduct." For these reasons, the court granted the defendants' motion to dismiss without prejudice.
