This case sought judicial determination as to whether federal agencies under the Trump Administration could lawfully rescind certain collective bargaining agreements (CBAs) with government unions. On March 27, 2025, President Trump signed Executive Order 14251, exempting certain federal agencies from participating in federal labor-management programs based on national security responsibilities. Following the order, the Office of Personnel Management issued guidance encouraging these agencies to terminate CBAs and adopt personnel policies aligned with the President’s priorities.

That same day, the Department of Defense and seven other federal agencies filed suit against the American Federation of Government Employees District 10 (AFGE District 10) and its local unions in the Western District of Texas, seeking a declaratory judgment authorizing termination of the CBAs in accordance with the executive order. The case was assigned to Judge Alan D. Albright. 

In their complaint, the plaintiff agencies argued that President Trump’s priorities to enhance federal workforce efficiency and national security were hindered by existing CBAs, particularly those negotiated late in the prior administration. They cited provisions they viewed as restrictive, including rules on telework, performance plans, union activities, disciplinary limits, notice for reductions in force, and bargaining over policy changes. Plaintiffs further asserted that the Executive Order was a lawful exercise of presidential authority under 5 U.S.C. § 7103(a)(3) and Article II.

Defendants moved to dismiss on April 21, 2025, arguing that plaintiffs lacked Article III standing, that venue was improper, and that the court should decline to hear a preemptive declaratory judgment on proposed future actions. Plaintiffs opposed the motion on May 5, and a hearing was held on June 10.

On July 23, 2025, Judge Albright granted the defendants’ motion to dismiss. Judge Albright determined that "[p]laintiffs [were] ask[ing] this Court to do something it should not and cannot do: issue a declaratory judgment pre-approving the acts of executive agencies absent a legally cognizable injury-in-fact.” The court further emphasized that it was unaware of any instance where a federal court had exercised jurisdiction to grant agencies a pre-enforcement declaratory judgment approving their proposed future actions. The court found that it lacked jurisdiction because (i) the injuries identified by Plaintiffs do not constitute redressable injuries-in-fact and therefore do not establish standing, and (ii) by seeking this Court’s advance approval of their proposed future actions, Plaintiffs improperly request an advisory opinion. 2025 WL 2058374. 

On September 19, 2025, the plaintiff agencies appealed the district court’s July 2025 judgment to the U.S. Court of Appeals for the Fifth Circuit. On November 25, 2025, the plaintiff-appellants filed a consent motion to voluntarily dismiss the appeal pursuant to Fed. R. App. P. 42. The reason for this dismissal has not been made public. The Court granted the voluntary dismissal on December 2, 2025.
