It was filed on March 26, 2025, in the U.S. District Court for the Northern District of California, by Community Legal Services in East Palo Alto, Social Justice Collaborative, Amica Center for Immigrant Rights, Estrella del Paso, Florence Immigrant and Refugee Rights Project, Galveston-Houston Immigration Representation Project, Immigrant Defenders Law Center, National Immigrant Justice Center, Northwest Immigrant Rights Project, Rocky Mountain Immigrant Advocacy Network, Vermont Asylum Assistance Project. The Plaintiffs sued the U.S. Department of Health and Human Services (HHS), HHS's Office of Refugee Resettlement (ORR), and the Department of the Interior (DOI). The complaint alleges that the government's funding termination violates the Trafficking Victims Protection Reauthorization Act (TVPRA) and the Administrative Procedure Act (APA). It seeks a declaratory judgment and a nationwide injunction to compel the government to reinstate this funding and continue providing legal counsel. The Plaintiffs were represented by Immigrants Defender Law Center, Justice Action Center and Amica Center for Immigrant Rights. The case was assigned to District Judge Araceli Martinez-Olguin.

On March 27, 2025, the Plaintiffs filed a motion seeking a Temporary Restraining Order; Judge Martinez-Olguin set a hearing on that motion for April 1.  On April 1, 2025, the Court granted the Plaintiff's Motion for a Temporary Restraining Order that remained in effect until 7:59 a.m. P.S.T. of April 16, 2025. On April 4, 2025, the Plaintiffs filed a Motion for Preliminary Injunction. However, on the same day, the Defendants filed a Motion to Dissolve the Temporary Restraining Order on the basis that there had been a significant change in controlling law, affirming the discretion of federal agencies to make funding determinations without judicial interference, following the Supreme Court decision Department of Education v. California.

On April 7, 2025, the Plaintiffs filed a Motion to Enforce Judgment as the Defendants had not complied with the Court's Temporary Restraining Order. On April 9, 2025, the Defendants filed a Motion of Recusal of a District Judge alleging that Judge Martinez-Olguin was biased towards the Plaintiffs due to having previously worked as a managing attorney at Community Legal Services in East Palo Alto. Due to the Motion of Recusal, the Court ordered an extension of the Temporary Restraining Order until 7:59 a.m. P.S.T. of April 30, 2025. The Court also ordered that the Plaintiffs' motion for preliminary injunction the Defendants' motion to dissolve the temporary restraining order be heard on April 23, 2025 at 2:00 p.m. P.S.T.

The case is ongoing.
