This case, brought by the Department of Treasury under the second Trump Administration, sought a declaratory judgment allowing the Department to rescind or repudiate collective bargaining agreements with the National Treasury Employees Union (NTEU). Under the Federal Service Labor-Management Relations Statute (FSLMRS) Congress provided for the collective bargaining rights of federal employees, stating that “the statutory protection of the right of [federal] employees to organize, bargain collectively, and participate through labor organizations of their own choosing in decisions which affect them . . . safeguards the public interest.” However, Congress also provided that the President can exclude agencies or agency subdivisions from FSLMRS's protections if the President determines that "(A) the agency or subdivision has as a primary function intelligence, counterintelligence, investigative, or national security work, and (B) the provisions of [the statute] cannot be applied to that agency or subdivision in a manner consistent with national security requirements and considerations."

Under Executive Order 14251, issued by President Trump on March 27, 2025, around a dozen agencies beyond those historically excluded from the FSMLRS, and including the Department of Treasury, have as "a primary function intelligence, counterintelligence, investigative, or national security work" and the FSLMRS cannot be applied to them in a “manner consistent with national security requirements and considerations." The next day, the Department filed suit in the District Court for the Eastern District of Kentucky "seeking a declaration that it has the power to terminate its national collective bargaining agreement and other supplemental agreements" with the defendants. Represented by counsel from the attorney general's office, the Department argued that the EO validly excluded the Department from the requirements of the FSMLRS and requested the court to issue a declaration authorizing the Department to terminate the collective bargaining agreement. 

The case was assigned to District Judge Danny C. Reeves. On April 18, the Department filed a motion for summary judgment, and the defendants filed a cross-motion for summary judgment on April 24. The defendants also filed a motion to dismiss. On May 20, 2025, Judge Reeves issued an opinion granting the defendants' motion for summary judgment and denying that of the Department. The court held that it did not have subject-matter jurisdiction over the case for several reasons. First, the court found that there was not a "case or controversy" as required to establish standing, since the Department "has not provided persuasive evidence that the [EO] was enforced against Chapter 73 when the Complaint was filed." Instead, it simply argued that it wished to do so, which does not amount to an actual controversy. The court also found that the Department had not suffered an injury in fact, since it only alleged speculative injuries based on its fear of legal action against it if it attempted to implement the EO. Finally, the court found that a declaratory judgment would not redress the Department's injuries, since the Department sued only Chapter 73, not the entirety of NTEU, meaning that NTEU would not be bound by the judgment and could still seek to enforce the collective bargaining agreements. 

Based on its findings, the court held that it lacked subject-matter jurisdiction over the case. While emphasizing that it was expressing no opinion on the merits of the case, the court said that it was bound by the timeline and facts before it, and therefore it granted the defendants' motion for summary judgment. The judgment was entered that same day.
