This case challenged President Trump's attempt to impose sweeping global tariffs without congressional authorization.

On April 14, 2025, five businesses that relied on international imports filed this lawsuit in the United States Court of International Trade challenging recent executive orders that imposed significant new tariffs on imports from China and many other countries. They named several federal government persons and entities, including President Donald Trump, U.S. Customs and Border Protection, and the Secretary of Commerce as Defendants. Represented by the Liberty Justice Center, the plaintiffs sought declaratory relief, injunctive relief, and damages.

Plaintiffs claimed that the President’s actions exceeded statutory authority under the International Emergency Economic Powers Act (IEEPA), violated the nondelegation doctrine, and infringed upon Congress’s constitutional authority to regulate foreign commerce and impose tariffs. They argued that the President’s justification—longstanding bilateral trade deficits—did not constitute an “unusual and extraordinary threat” justifying emergency powers under IEEPA. They alleged that the tariffs, which include a blanket 10% duty on imports from nearly every country and higher rates targeting specific nations like China, violated statutory limits and the Constitution's separation of powers. The EOs were cited as causing severe economic hardship, forcing price hikes, disrupting supply chains, and threatening business viability.

The case was assigned to a three-judge panel—Judges Gary S. Katzmann, Timothy M. Reif, and Jane A. Restani. On April 18, 2025, plaintiffs filed an emergency motion for a temporary restraining order and preliminary injunction. The plaintiffs argued that the tariffs imposed massive economic burdens without congressional oversight, and if upheld, would mark the broadest expansion of presidential economic authority in U.S. history. The court denied the TRO on April 22, finding no immediate irreparable harm, but scheduled a full hearing for May 13 and ordered expedited briefing. 2025 WL 1178581.

On May 28, 2025, the court granted plaintiffs' motion for summary judgment and denied their motion for preliminary injunction as moot. The court found that the President unconstitutionally exceeded his delegated authority under the IEEPA and the tariffs acted as leverage rather than directly "deal[ing] with" the stated threats. The court permanently enjoined enforcement of the challenged tariff orders. 772 F.Supp.3d 1350. Defendants filed a notice of appeal to the U.S. Court of Appeals for the Federal Circuit, and the court granted their motion to stay enforcement of the judgments pending appeal that same day.

One day later, the Federal Circuit granted defendants' motion to consolidate the appeals of this case and State of Oregon v. Trump. 2025 WL 1527040. It issued a temporary stay of the judgments and permanent injunctions. The court set a briefing schedule to determine whether the stay should remain in effect during the pendency of the appeal. On June 10, the court granted a stay pending appeal and ordered that the consolidated cases be heard en banc. 2025 WL 1649290.

The Federal Circuit affirmed the Court of International Trade’s decision regarding summary judgment on August 29, 2025, agreeing that IEEPA’s grant of presidential authority to regulate imports did not authorize the tariffs imposed by the Executive Orders.

On September 3, 2025, defendants filed a petition for a writ of certiorari and a motion to expedite consideration with the Supreme Court of the United States (SCOTUS). SCOTUS granted both the petition and motion on September 9, 2025 and consolidated the case with Learning Resources, Inc. v. Trump. Oral argument was set for November 5, 2025. 

This case remains ongoing.
