This case concerns a lawful permanent resident who was arrested and detained while attending a naturalization interview by the Department of Homeland Security (DHS) in retaliation for his outspoken criticism and protest of Israel’s military actions in Gaza. On April 14, 2025, Mohsen Mahdawi filed a petition for writ of habeas corpus in the U.S. District Court for the District of Vermont, challenging his detention. Mahdawi—who has lived in the U.S. for over a decade, is a recent student of Columbia University, with an expected graduation date of May 2025, and is set to begin graduate studies at Columbia’s School of International and Public Affairs in Fall 2025—was arrested by DHS agents while attending his naturalization interview. The named respondents include President Trump, Secretary Rubio, DHS Secretary Kristi Noem, Attorney General Pamela Bondi, and multiple ICE officials. The petition alleges that Mahdawi's detention is part of a broader policy adopted by the Trump administration to retaliate against noncitizens for engaging in constitutionally protected speech that is critical of Israel and supportive of Palestinian rights.

The petition listed Ozturk v. Hyde, 2:25-cv-00374, as related, so the case was initially assigned to that case's judge, William Sessions. 

According to the petition, the administration's policy was formalized through Executive Orders 14161 and 14188 and operationalized through a discretionary practice wherein noncitizens are deemed deportable if Secretary of State Marco Rubio determines that their presence has adverse foreign policy consequences. Mr. Mahdawi’s arrest follows the detention of Mahmoud Khalil under similar circumstances.

Mahdawi seeks immediate release and raises claims under the First Amendment, the Due Process Clause of the Fifth Amendment, the Administrative Procedure Act, and the non-delegation doctrine. He also challenges the legality and constitutionality of the government’s underlying policy and the so-called “Rubio Determination” used to justify his detention.

On the same day that he filed the petition, Mahdawi also filed an emergency motion for a temporary restraining order to prevent his deportation. Judge Sessions granted the motion, enjoining the respondents from removing Mahdawi from the United States or transferring him out of the District of Vermont. 

On April 15, 2025, the court found that the case was not properly considered related to Ozturk v. Hyde; accordingly, it was randomly reassigned to District Judge Geoffrey William Crawford, who set a status conference date of April 23, 2025.  The day before the conference, Mahdawi filed a motion seeking release on bond. After the conference, Judge Crawford made several orders:

  • He set a hearing date for April 30, 2025, on the issue of release, and ordered the government to bring Mahdawi to that hearing.
  • He converted the government's response to the petition to a motion to dismiss, and set a briefing schedule for it.
  • He extended the TRO for 90 days or until the case was dismissed or a ruling was made on the preliminary injunction.

On April 30, 2025, the court ordered Mahdawi released immediately and denied the government's motion for a stay. His release was ordered because his detention had become unreasonably prolonged, with no realistic prospect of removal to Iraq. The government failed to show he was a danger or flight risk, and his continued detention without progress or due process violated his constitutional rights. 

On May 1, 2025, the government appealed to the U.S. Court of Appeals for the Second Circuit. On May 9, the Second Circuit denied a stay of the release order, holding that the government's jurisdictional arguments were unlikely to succeed. It found no irreparable harm to the government and ruled that the balance of equities and public interest favored Mahdawi's release. 

On May 18, in the Second Circuit, Defendant-Appellants filed a petition for rehearing en banc. 

This case is ongoing.
