On April 15, 2025, three anonymous law students filed this lawsuit against the Equal Employment Opportunity Commission (EEOC) and its Acting Chair in the United States District Court for the District of Columbia. The Plaintiffs are represented by Democracy Forward, a public interest organization. The case is being heard by Judge Reggie B. Walton.

The students, who applied for jobs at law firms under investigation by the EEOC, claimed the government’s investigation of those law firms violated their reasonable expectation of privacy. As part of the government's investigation against the law firms, the EEOC demanded the firms turn over sensitive personal information about their applicants and employees. The plaintiffs alleged that the EEOC has no statutory authority to make this demand. On May 16, 2025, the Plaintiffs filed an amended complaint that included class-action allegations on behalf of a proposed class of employees and applicants affected by the investigation.

Plaintiffs sought declaratory and injunctive relief. They requested that the court declare the investigation unlawful and beyond the EEOC’s statutory authority. The Plaintiffs further requested that the court enjoin the Defendants from conducting further unlawful investigations of law firms, order the Defendants to cease ongoing investigations and to return any sensitive information gained from the law firms currently under investigation.

The plaintiffs filed a motion for summary judgment and class certification on June 5, 2025. The defendants responded by moving to defer consideration of the motion for summary judgement and by requesting more time to respond to the amended complaint. The court granted the following parts of the motion:

  1. An extension of time to respond to the amended complaint.
  2. An extension of time to respond without prejudice.
  3. A denial without prejudice for the plaintiffs' motion for class certification.

The motion to defer consideration for summary judgement was denied. 

On July 31, the defendants filed a combined opposition to the plaintiffs' motion for summary judgement and moved to dismiss, or in the alternative, moved for summary judgement.

 

 This case is ongoing.
