In March 2025, President Trump issued Proclamation No. 10903, 90 Fed. Reg. 13034, invoking the AEA to detain and remove Venezuelan nationals "who are members of TdA" [a gang, Tren de Aragua] (the Proclamation). In J.G.G. v. Trump, twelve detainees and a putative class sought injunctive and declaratory relief against their removal under the AEA, in a the U.S. District Court for the District of Columbia.  Chief Judge James Boasberg issued a temporary restraining order (TRO). (The putative class included A.S.R., the petitioner in this case.)

The Supreme Court reversed the J.G.G. TRO on the grounds that the right method for the Venezuelans to proceed was by filing a habeas petition in the district in which they were being held.

On April 15, 2025, A.S.R., a Venezuelan man represented by the ACLU, filed this class petition for writ of habeas corpus in the United States District Court for the Western District of Pennsylvania in response to the Supreme Court decision. He challenged the Trump Administration's use of the AEA to deport himself and other Venezuelan men for alleged gang activity without due process. Judge Stephanie L. Haines granted a TRO the same day, enjoining Defendants from removing the petitioner or class members from the jurisdiction of the court.

The government held A.S.R. in the Western District of Pennsylvania at the time he filed this petition on April 15, but transferred him to Texas later on the same morning.  The government appealed the TRO arguing in part that Judge Haines lacked jurisdiction due to A.S.R.'s location. Judge Haines found on April 25 that the parties agreed that A.S.R. was in the district at the time of filing and confirmed jurisdiction. She also certified the class, and extended the TRO to May 13. 

On May 5, 2025, Judge Haines held a preliminary injunction hearing. During the hearing the government argued that prior to April 16, 2025, ICE reviewed A.S.R.'s case and concluded that he was not subjected to the Proclamation and lacked standing to bring this case.  The government declined to guarantee to Judge Haines "with absolute certainty" that the government would not "deem A.S.R. to be subject to removal under the Proclamation in the future."  Separately, the government informed Judge Haines that they were providing individuals designated for removal under the AEA at least 12 hours' notice in order to indicate that they will seek habeas relief, and an additional 24 hours to file in habeas if desired. The government stated it did not intend to remove an individual pending litigation. 

On May 13, 2025, Judge Haines found that a duly-designated Foreign Terrorist Organization (FTO) under Title 8, U.S.C. Section §1189 was "“the modern equivalent of the ‘enemies, pirates, and robbers,’ committing ‘incursions’ around the time of the AEA.”  Secretary of State Rubio designated TdA as a FTO.  As such, the Proclamation met the definition of "predatory incursion" under the AEA.  Judge Haines noted TdA's FTO designation could have been appealed in the U.S. Court of Appeals for the District of Columbia Circuit and that "Congress has not blocked or revoked this designation, and the D.C. Circuit has not rendered a decision finding it unlawful."  The Court concluded, based on this interpretation of the law, that A.S.R. had not shown a likelihood of success on establishing that "the Proclamation does not comply with the AEA" and denied the petitioners' motion for a preliminary injunction in this respect.

The Court held that as long as the Government provided sufficient notice and due process, the President may issue a Proclamation pursuant to the AEA directing "the removal of: (1) Venezuelan citizens, (2) who are fourteen (14) years of age or older, (3) who are within the United States, (4) who are neither actually naturalized nor lawful permanent residents, and (5) who are members of Tren de Aragua ("TdA"), which is a Foreign Terrorist Organization ("FTO").”

Judge Haines granted an injunction requiring Respondents to provide the twenty-one days' notice and an opportunity to be heard to A.S.R. The notice must "clearly articulate the fact that he is subject to removal under the Proclamation and the AEA." This order implemented the Supreme Court order in Trump v. J.G.G.   

Judge Haines asserted that the Court had jurisdiction over A.S.R.'s petition because the facts asserted by A.S.R.’s counsel “very strongly suggest that as of April 15, 2025,at 10:38 A.M. [the time A.S.R. filed his petition], A.S.R was “in custody” under the AEA and the Proclamation.” The Court dismissed government arguments to the contrary, including holding “even if Respondents did subsequently shift him to removal proceedings under the INA, that subsequent action does not deprive this Court of jurisdiction, which is measured at the time the Petition is filed.” 

Judge Haines held that A.S.R. had standing to being this petition because “when he filed his Petition, A.S.R. was personally facing removal from the United States (a concrete, particularized, and actual or  imminent injury) under the AEA and the Proclamation (the challenged action) that was redressable by a favorable ruling from this Court (in the form of an injunction, a declaration, the grant of a writ of habeas corpus, or the like).” The Court held that the government's May 5 assertions attempting to defeat jurisdiction did not succeed.

In a second order on May 13, 2025, Judge Haines decertified the class announced on April 25 on the basis that A.S.R. failed to provide evidence of a single non-citizen in the Western District of Pennsylvania who was or will be subject to removal under the Proclamation and the AEA.

OPINION - As the Court stressed at the beginning of this Opinion, this case implicates significant issues. In resolving those issues, this Court's unflagging obligation is to apply the law as written. When the Court does so, it finds that the P roclamation now at issue complies with the AEA, and the Court further finds that Respondents must provide greater notice to those subject to removal under the AEA than they are currently providing.
