This case challenged the decision by the Department of Health and Human Services (HHS) and its component Centers for Disease Control and Prevention (CDC) to terminate over $11 billion in congressionally appropriated grants to state and local governments. The grants were designed to fund outbreak prevention programs and to ameliorate the devastation of the COVID-19 pandemic. To terminate these grants, HHS and the CDC were statutorily required to make a determination that the individual recipient of a grant had in some way violated federal laws or regulations or the Constitution itself. HHS and the CDC did not undertake these case-by-case evaluations, instead ending the grants en masse and without alleging any violation of federal law by any of the grant recipients. Plaintiffs, four municipalities and an AFL-CIO union of municipal employees, alleged that HHS and the CDC’s revocation of their funding violated separation of powers, the Spending Clause, and the Administrative Procedure Act.

Plaintiffs—Harris County, Texas, Davidson County, Tennessee, the cities of Columbus, Ohio and Kansas City, Missouri, and the American Federation of State, County and Municipal Employees—filed this lawsuit on April 24, 2025, in the U.S. District Court for the District of Columbia. The lawsuit sued HHS and its Secretary, Robert F. Kennedy Jr., as well as the Centers for Disease Control (CDC) and its Acting Director. Plaintiffs sought vacatur of defendants’ grant termination decisions and an injunction requiring defendants to reinstate the cancelled grants, spend the money appropriated by Congress, and resume the normal operation of the grant programs; and attorneys’ fees. The case was assigned to Judge Christopher Reid Cooper.

On June 17, 2025, the court granted in part and denied in part plaintiffs' motion for a preliminary injunction. The court ordered injunctive relief for the plaintiffs themselves, but declined to order an injunction nationwide. The court found that plaintiffs had not sufficiently alleged "diffuse, nationwide" harms stemming from defendants' actions that would justify a nationwide injunction. The court stipulated that it might well set aside, as required by the APA, all of defendants' grant terminations if it ultimately found the blanket terminations unlawful.

On July 15, 2025, plaintiffs moved for partial reconsideration of the court's preliminary injunction. Plaintiffs requested that the court extend injunctive relief to municipal workers in the state of Alaska and to Jackson County, Ohio, whom the court had previously judged at risk of irreparable harm but did not include in its preliminary injunction.

The court has ordered the parties to propose a joint or competing briefing schedules.

MINUTE ORDER: In their opposition to 14 Plaintiffs' Motion for a Preliminary Injunction, Defendants argued that they complied with the appropriations bills at issue in this case by "obligating" the appropriated funds through grants to state and local governments. See ECF 21 at 27-28. At argument, government counsel indicated his belief that the government has not just obligated those funds but has in fact "paid out the minimum amounts appropriated by Congress."
