On April 24, 2025, three nonprofit organizations filed this lawsuit in the United States District Court for the District of Columbia against the U.S. Department of Homeland Security and its Secretary. They challenged Defendants' shuttering of three offices within DHS: the Office for Civil Rights and Civil Liberties (CRCL), the Citizenship and Immigration Services Ombudsman Office (CIS-Omb), and the Office of the Immigration Detention Ombudsman (OIDO). CRCL is charged by statute with receiving and adjudicating complaints of civil rights abuses by DHS. CIS-Omb is charged by statute with assisting individuals and employers who are having problems with visas, work permits, and other immigration issues. OIDO is charged by statute with receiving complaints and reporting to Congress about violations of law, professional standards, and contract terms by operators of public or private detention facilities. The Plaintiffs alleged that the Defendants' actions to eliminate these offices exceeded Defendants' authority and violated Separation of Powers and the Administrative Procedure Act. The case was assigned to District Judge Ana C. Reyes.

On May 8, plaintiffs filed a motion for a Preliminary Injunction (PI). Following a hearing, the court took the matter under advisement. On May 23, plaintiffs filed a motion for a Temporary Restraining Order (TRO). That same day, the court denied the TRO motion without prejudice, noting that the motion for a PI remained under consideration. They ordered that the parties provide confirmation by May 27 that the job vacancies can be posted, and submit a joint status report by June 2. 

On May 27, the parties submitted a joint status report addressing the current job vacancy status. Defendants asserted that the offices were permitted to create new positions and seek applicants, while plaintiffs contended that they lacked sufficient information to verify that claim. On June 2, the court ordered defendants to file another status report providing further updates on or before July 2, 2025.  

That same day, plaintiffs submitted a status report outlining the perceived deficiencies in defendants' efforts to resume the statutory functions of the offices. The court scheduled a status conference for June 12, 2025. In advance of the hearing, plaintiffs filed an additional status report describing the ongoing harms to both plaintiffs and the public. 

Following the hearing, the court ordered defendants to inform the court by June 16 whether DHS had communicated with the Executive regarding the language in the Fiscal Year 2026 budget stating that OIDO had been "eliminated in its entirety," and, if so, to describe the nature of those communications. On June 16, defendants submitted a declaration detailing DHS's budget process and the funding status of OIDO. Defendants filed a response two days later, reiterating their request for the court to issue an injunction or, in the alternative, to permit discovery into defendants' actions concerning the offices since January 20, 2025. 

The case is ongoing.
