On May 2, 2025, eight cities and counties across five states—Washington, California, Massachusetts, Ohio, and New York—filed this lawsuit in the U.S. District Court for the Western District of Washington against the U.S. Department of Housing and Urban Development, the U.S. Department of Transportation, the Federal Transit Administration, and their agency heads as Defendants. They challenged defendants' conditioning of Congressionally-appropriated grants—including funds meant to serve unhoused …

On May 2, 2025, eight cities and counties across five states—Washington, California, Massachusetts, Ohio, and New York—filed this lawsuit in the U.S. District Court for the Western District of Washington against the U.S. Department of Housing and Urban Development, the U.S. Department of Transportation, the Federal Transit Administration, and their agency heads as Defendants. They challenged defendants' conditioning of Congressionally-appropriated grants—including funds meant to serve unhoused people and provide critical transit services—on Plaintiffs' compliance with executive orders pertaining to immigration, transgender rights, and diversity, equity, and inclusion programs.  The case was assigned to District Judge Babara Rothstein.  

On May 5, 2025, plaintiffs sought a temporary restraining order (TRO) preventing the government from imposing the challenged grant conditions; delaying, withholding, or canceling funds based on the challenged grant conditions, or requiring any kind of certification related to compliance with the challenged grant conditions. The court granted the requested TRO on May 7, setting it to last for 14 days, while preliminary injunction (PI) briefing proceeded. 2025 WL 1331488. 

On May 21, 2025, plaintiffs filed an amended complaint adding several cities, transportation agencies, and housing organizations as parties. They subsequently filed a second motion for a TRO and PI. On May 23, the court granted the TRO, effective through June 4, 2025. 

On June 3, 2025, the court granted plaintiffs' first and second motions for a PI. Judge  Rothstein wrote that the balance of equities weighed in plaintiffs' favor as plaintiffs would otherwise be forced to choose between two untenable options, and as defendants were unable to convince the court that they would suffer material harm from the injunction. 2025 WL 1582368. The court's order enjoined defendants from enforcing the challenged CoC grant conditions, withholding or delaying funds based on those conditions, requiring related certifications, or retaliating against plaintiffs for participating in the lawsuit.

On June 9, 2025, defendants filed an appeal with the U.S. Court of Appeals for the Ninth Circuit. 

On July 10, 2025, the plaintiffs filed their second amendment complaint, which adds HHS, agencies of HHS, and Secretary Robert F. Kennedy, Jr. as defendants. It expanded its challenge to include HHS grant conditions in addition to HUD and DOT conditions. Moreover, it expands the plaintiff coalition and details over $12 billion in threatened funds and describing specific HHS programs (e.g., Ryan White HIV/AIDS, Head Start) at risk.

On July 14, 2025, the plaintiffs filed a third motion for a PI, which the court granted in an order on August 12, 2025. The injunction covers the newly added plaintiffs (those in the Second Amended Complaint) and prevents HUD, DOT, and HHS from enforcing the challenged funding conditions on their grants.

The case is ongoing.
