This is a case about whether Colorado schools could keep sports teams, locker rooms, and overnight travel rooms separated by biological sex without violating state anti-discrimination rules. On May 9, 2025, School District 49 filed the suit in the United States District Court for the District of Colorado. It was an individual institutional lawsuit, not a class action. The case was assigned to Senior U.S. District Judge John L. Kane. District 49 sued Aubrey Sullivan, Director of the Colorado Civil Rights Division; Phillip Weiser, Colorado Attorney General; members of the Colorado Civil Rights Commission; the Colorado High School Activities Association (CHSAA); Michael Krueger, CHSAA’s commissioner; and CHSAA board members. Represented by private counsel from First & Fourteenth PLLC, the district brought a constitutional challenge under the Fourteenth Amendment, through 42 U.S.C. § 1983, and sought declaratory relief, permanent injunctions, attorneys’ fees under 42 U.S.C. § 1988, and other equitable relief.

The dispute grew out of a policy the district had adopted the day before filing suit, on May 8, 2025. That policy reserved girls’ teams for biological females, boys’ teams for biological males, and barred boys from girls’ locker rooms or hotel rooms, and vice versa. District 49 alleged that Colorado’s Anti-Discrimination Act (CADA) and CHSAA bylaws put it in an impossible position: if it followed state rules, it said it would undermine equal athletic opportunity for girls and student privacy; if it kept its own policy, it risked investigations, fines, and athletic sanctions. The complaint framed the case as a pre-enforcement challenge and pleaded four Equal Protection theories: sex discrimination in athletic opportunity and benefit, bodily privacy and safety, and parallel claims asserted on behalf of students.

The case broadened on July 22, 2025, when the plaintiffs filed an amended complaint. That pleading added Colorado Springs School District 11, Academy School District 20, Education reEnvisioned BOCES, Monument Academy, James Irwin Charter Schools, Montezuma-Cortez School District, and The Classical Academy. The amended complaint kept the same core theory and same requested remedies, but it transformed the suit from a single-district challenge into a coordinated action by multiple Colorado public-school entities and charter-school operators challenging how CADA and CHSAA rules were being applied to sex-separated athletics and private spaces.

The litigation then turned to threshold dismissal issues instead of merits discovery. On August 8, 2025, the state defendants filed a joint motion to dismiss, and the CHSAA defendants filed a separate motion to dismiss. On August 23, 2025, the court stayed discovery pending those motions. The plaintiffs responded on September 12, 2025, the defendants replied on September 26, 2025, and Magistrate Judge Braswell held oral argument on December 8, 2025, after the court had set the motions for hearing earlier that fall.

Before the court ruled on the merits of those motions, part of the case split off through settlement. On December 2, 2025, the plaintiffs notified the court that they had reached a settlement with the CHSAA defendants. After a short extension, the parties filed dismissal papers, and on January 13, 2026, the court dismissed CHSAA, Michael Krueger, and the CHSAA board defendants with prejudice. On January 14, 2026, the court then treated CHSAA’s motion to dismiss as moot.

That left the claims against the remaining state officials. Also on January 13, 2026, Magistrate Judge Braswell issued a written recommendation that the state defendants’ motion to dismiss be granted and that the remaining claims be dismissed with prejudice. 2026 WL 96671. The recommendation said the school plaintiffs could not use the Fourteenth Amendment to sue their parent state in this posture, and they also could not press these claims on behalf of “all students” because student interests were not all aligned and students were not meaningfully prevented from suing on their own. The plaintiffs moved for more time to object, received an extension, filed objections on February 10, 2026, and the state defendants filed their response on March 10, 2026. As of April 3, 2026, no decision has been made.

The case is ongoing.
