In this case, the Department of Justice (DOJ) under the second Trump Administration filed a lawsuit in the U.S. District Court for the Eastern District of North Carolina, alleging violations of the Help America Vote Act of 2002 (HAVA). This act requires states that maintain centralized voter registration databases to keep accurate lists of registered voters. To successfully register to vote, an applicant must provide either a driver's license number, the last four digits of their social security number, or, if those are not available, a special identifying number assigned by the state. However, the DOJ alleged that the State of North Carolina "used a state voter registration form that did not explicitly require a voter to provide a driver's license or the last four digits of a Social Security number," but nevertheless registered many voters who did not provide such information in violation of HAVA. The defendants admitted the violations in an administrative proceeding but took only limited actions to remedy the violations. Specifically, the DOJ alleged that the defendants failed to take steps to update the state registration database with each voter's driver's license number, social security number, or unique identifying number.

On May 27, 2025, DOJ sued the State of North Carolina, the North Carolina State Board of Elections (NCSBE), the Executive Director of the NCSBE, the Chair of the NCSBE, the Secretary of the NCSBE, and three individual board members under the authority granted to the Attorney General in HAVA. DOJ asked the court to declare that the defendants were not in compliance with HAVA, to enjoin the defendants from using a voter registration form that violates HAVA, and to order the defendants to develop a plan to remedy any identified HAVA violations. The case was assigned to District Judge Louise W. Flanagan. 

On June 2, the North Carolina Alliance for Retired Americans moved to intervene in the case as a defendant. The Alliance, a nonprofit social welfare organization that works to ensure social and economic justice for retirees, argued that the lawsuit threatened the Alliance's goal of registering members to vote and ensuring that members stay registered. The Alliance argued that its interests were inadequately represented by the current defendants because they were public officials rather than private citizens, leading to a mismatch of interests. As evidence, the Alliance cited the changing composition of the State Board and the rumored possibility of a settlement in the case.

On June 17, the Democratic National Committee also moved to intervene, arguing that the case would harm its interests, since "the federal government’s actions, if successful, will require Democratic voters who are unrepresented in this action to provide additional personal information to the State of North Carolina to maintain their registered status, when federal law does not impose such a requirement." The Committee argued that it would then be forced to divert resources in order to cure the supposed deficiencies, which, if left unremedied, would burden the votes of DNC members. Also on June 17, a group of voters, the League of Women Voters of North Carolina and the NAACP North Carolina State Conference moved to intervene, arguing that if the case were to settle, any settlement would "come[] at the expense of eligible voters, such as the Impacted Voters and the members and constituents of the Impacted Groups, who, through no fault of their own, may find themselves on the state’s supposed “fix it” list." 

On June 20, the court stated that, for the "continued efficient administration of justice," the case was reassigned to Chief United States District Judge Richard E. Myers II.
